This order contains effluent limits for TDS and total nitrogen to control the interim wastewater <br /> discharge such that waste strength does not increase while the Discharger conducts the tasks <br /> required by this Order. It is anticipated that the revised WDRs issued as a result of this Order will <br /> contain significantly lower effluent concentrations. This Order also contains interim flow limits to <br /> such that the Discharger will be able to dispose of its wastewater and cooling water in compliance <br /> with the Specifications of WDRs Order No. 91-223. <br /> VIOLATION OF THE WASTE DISCHARGE REQUIREMENTS <br /> 14. WDRs Order No. 91-223 states: <br /> "The discharge, in combination with other sources, shall not cause underlying <br /> groundwater to be degraded. These requirements may be reopened to include additional <br /> groundwater limitations." <br /> 15. In June 2000, the Discharger constructed five groundwater monitoring wells at the facility. Based <br /> on five monitoring events, the water table exists approximately 58 feet below the ground surface. <br /> Well MW-1 is upgradient of the facility; Wells MW-2, MW-4, and MW-5 are downgradient of <br /> LAAs; Well MW-3 is downgradient of the cooling water LAAs. NO3 as N denotes Nitrate as Nitrogen. <br /> 16. As indicated in the table above, the TDS, sodium, and chloride concentrations in downgradient <br /> wells MW-2, MW-4, and MW-5 are at least two to three times higher than the concentrations in <br /> the upgradient well, MW-1. This data indicates the discharge of waste from Escalon Cellars has <br /> degraded the underlying groundwater. <br /> REGULATORY CONSIDERATIONS <br /> 17. As a result of the events and activities described in this Order, the Regional Board finds that the <br /> Discharger has caused or permitted waste to be discharged in such a manner that it has created, <br /> and continues to threaten to create, a condition of pollution or nuisance.
