Any person affected by this action of the Regional Board may petition the State Water Resources <br /> Control Board to review the action in accordance with Section 2050 through 2068, Title 23, <br /> California Code of Regulations. The petition must be received by the State Water Resources <br /> Control Board, Office of Chief Counsel, P.O. Box 100, Sacramento, CA, 95812-0100, within 30 <br /> days of the date on which the Regional Board action took place. Copies of the law and regulations <br /> applicable to filing petitions are available at www.swrcb.ca.gov/water laws/index.htm] and also <br /> will be provided upon request. <br /> IT IS HEREBY ORDERED that, pursuant to Sections 13301 and 13267 of the California Water Code, <br /> Canandaigua Wine Company, its agents successors, and assigns, shall in accordance with the following <br /> tasks and time schedule, implement the following measures and the facility upgrades required to ensure <br /> long-term compliance with WDRs No. 91-223. <br /> Any person signing a document submitted under this Order shall make the following certification: <br /> "I certify underpenalty of law that I have personally examined and am familiar with the information <br /> submitted in this document and all attachments and that, based on my knowledge and on my inquiry of <br /> those individuals immediately responsible for obtaining the information, I believe that the information is <br /> true, accurate, and complete. lain aware that there are significant penalties for submitting false <br /> information, including the possibility of fine and imprisonment. " <br /> 1. The Discharger shall immediately comply with all aspects of WDRs Order No. 91-223, except for <br /> following two items: <br /> a. The Discharger shall comply with the Groundwater Limitations as of 1 July 2005. <br /> b. The Discharger shall comply with Prohibition A.3 "Discharge of waste classified as <br /> `hazardous, 'defined in Section 20164 of Title 27, CCR, or `designated', as defined in-Section <br /> 13173 of the California Water Code, is prohibited" as of 1 July 2005. <br /> 2. Effective 31 January 2003, the Discharger shall comply with the following monthly average <br /> effluent limitations: <br /> Constituent Non-Crush Season Limitation Crush Season Limitation <br /> Total Dissolved Solids 14,000 mg/L 5,000 mg/L <br /> Total Nitrogen 2,950 mg/L 300 mg/L <br /> 3. Effective 31 January 2003, the monthly average discharge from the east and west sumps shall not <br /> exceed a total of 140,000 gallons per day(gpd) except during the months August, September, and <br /> October when a total discharge of 450,000 gpd is allowed. The monthly average discharge from <br /> the cooling water sump shall not exceed 125,000 gpd except during the months of August, <br /> September, and October when a total discharge of 175,000 gpd is allowed. <br /> 4. Beginning with the first quarter of 2003, the Discharger shall submit Quarterly Project Status <br /> Reports.
