CEASE AND DESIST ORDER NO. CANANDAIGUA WINE COMPANY ESCALON CELLARS SAN JOAQUIN COUNTY "I certify underpenalty of law that I have personally examined and am familiar with the information submitted in this document and all attachments and that, based on my knowledge and on my inquiry of those individuals immediately responsible for obtaining the information, I believe that the information is true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment. " 1. The Discharger shall immediately comply with all aspects of WDRs Order No. 91-223, except for following two items: a. The Discharger shall comply with the Groundwater Limitations as of 1 July 2005. b. The Discharger shall comply with Prohibition A.3 "Discharge of waste classified as `hazardous, 'defined in Section 20164 of Title 27, CCR, or 'designated' as defined in Section 13173 of the California Water Code, is prohibited" as of 1 July 2005. 2. Effective 31 January 2003, the Discharger shall comply with the following monthly average effluent limitations: Constituent Non-Crush Season Limitation Crush Season Limitation Total Dissolved Solids 14,000 mg/L 5,000 mg/L Total Nitrogen 2,950 mg/L 300 mg/L 3. Effective 31 January 2003, the monthly average discharge from the east and west sumps shall not exceed a total of 250,000 gallons per day. The monthly average discharge from the cooling water sump shall not exceed 100,000 gallons per day. 4. Beginning with the first quarter of 2003, the Discharger shall submit Quarterly Project Status Reports. The quarterly reports shall describe all work completed during the quarter in response to this Cease and Desist Order. Quarterly project status reports shall be submitted by the 1st day of the second month following the end of the quarter (i.e., the first quarter 2003 report is due by 1 May 2003) and may be combined with the monthly monitoring reports required by WDRs Order No. 91-223. 5. By 17 March 2003, the Discharger shall submit and begin implementing a Wastewater Characterization Workplan. The workplan shall describe a plan to identify all waste streams at the winery and perform sampling and analysis to characterize each waste stream. The workplan shall also address methods to determine the source of the trihalomethanes previously detected in the production wells at the facility. 6. By 2 June 2003, the Discharger shall submit a Solid Waste Disposal Plan that describes how and where solid waste is stored onsite, the locations that solid waste is disposed of(including owners' names, street addresses, and parcel numbers), the steps taken during hauling and disposal to ensure that the waste does not cause nuisance conditions or degrade the groundwater, and the entity V:\4anJoagain Noo IS\Statl\Obri-T\Sao Joaquu\\Canandaigua Eswlon Cellars\C&D R2.dm
