CEASE AND DESIST ORDER NO. <br /> CANANDAIGUA WINE COMPANY <br /> ESCALON CELLARS <br /> SAN JOAQUIN COUNTY <br /> "I certify underpenalty of law that I have personally examined and am familiar with the information <br /> submitted in this document and all attachments and that, based on my knowledge and on my inquiry of <br /> those individuals immediately responsible for obtaining the information, I believe that the information is <br /> true, accurate, and complete. I am aware that there are significant penalties for submitting false <br /> information, including the possibility of fine and imprisonment. " <br /> 1. The Discharger shall immediately comply with all aspects of WDRs Order No. 91-223, except for <br /> following two items: <br /> a. The Discharger shall comply with the Groundwater Limitations as of 1 July 2005. <br /> b. The Discharger shall comply with Prohibition A.3 "Discharge of waste classified as <br /> `hazardous, 'defined in Section 20164 of Title 27, CCR, or 'designated' as defined in Section <br /> 13173 of the California Water Code, is prohibited" as of 1 July 2005. <br /> 2. Effective 31 January 2003, the Discharger shall comply with the following monthly average <br /> effluent limitations: <br /> Constituent Non-Crush Season Limitation Crush Season Limitation <br /> Total Dissolved Solids 14,000 mg/L 5,000 mg/L <br /> Total Nitrogen 2,950 mg/L 300 mg/L <br /> 3. Effective 31 January 2003, the monthly average discharge from the east and west sumps shall not <br /> exceed a total of 250,000 gallons per day. The monthly average discharge from the cooling water <br /> sump shall not exceed 100,000 gallons per day. <br /> 4. Beginning with the first quarter of 2003, the Discharger shall submit Quarterly Project Status <br /> Reports. The quarterly reports shall describe all work completed during the quarter in response to <br /> this Cease and Desist Order. Quarterly project status reports shall be submitted by the 1st day of <br /> the second month following the end of the quarter (i.e., the first quarter 2003 report is due by 1 <br /> May 2003) and may be combined with the monthly monitoring reports required by WDRs Order <br /> No. 91-223. <br /> 5. By 17 March 2003, the Discharger shall submit and begin implementing a Wastewater <br /> Characterization Workplan. The workplan shall describe a plan to identify all waste streams at <br /> the winery and perform sampling and analysis to characterize each waste stream. The workplan <br /> shall also address methods to determine the source of the trihalomethanes previously detected in <br /> the production wells at the facility. <br /> 6. By 2 June 2003, the Discharger shall submit a Solid Waste Disposal Plan that describes how and <br /> where solid waste is stored onsite, the locations that solid waste is disposed of(including owners' <br /> names, street addresses, and parcel numbers), the steps taken during hauling and disposal to ensure <br /> that the waste does not cause nuisance conditions or degrade the groundwater, and the entity <br /> V:\4anJoagain Noo IS\Statl\Obri-T\Sao Joaquu\\Canandaigua Eswlon Cellars\C&D R2.dm <br />
