CEASE AND DESIST ORDER NO. <br /> CANANDAIGUA WINE COMPANY <br /> ESCALON CELLARS <br /> SAN JOAQUINCOUNTY <br /> responsible for actually applying the waste to land. <br /> 7. By 17 June 2003, the Discharger shall submit an LAA Operation and Maintenance Plan. The <br /> O&M Plan shall be prepared in accordance with Attachment A, and shall discuss all aspects of <br /> managing the discharge operation to comply with the terms and conditions of WDRs Order No. <br /> 91-223 (including Discharge Specifications B.5, B.6, and B.8), as well as the terms of this Cease <br /> and Desist Order. A copy of the O&M Plan shall be kept at the facility for reference by operating <br /> personnel and they shall be familiar with its contents. <br /> 8. By 1 August 2003, the Discharger shall submit a Vadose Zone Monitoring Workplan prepared in <br /> accordance with, and including the items listed in, the first section of Attachment B: Lysimeter <br /> Installation Workplan and Installation Report of Results. The workplan shall specify design <br /> details for lysimeters, proposed vadose zone monitoring locations, and proposed sampling <br /> techniques designed to ensure that representative samples of sufficient volume are obtained. <br /> 9. By 2 January 2004, the Discharger shall submit an Effluent Limitation Determination Technical <br /> Report, which identifies Constituents Of Concern (COCs) including TDS, sodium, chloride, <br /> nitrogen compounds, biochemical oxygen demand, pH, and metals in the wastewater and proposes <br /> effluent limitations that will not degrade groundwater quality. The effluent limitations must <br /> include an evaluation of the fate and transport of all COCs and clearly demonstrate that discharge <br /> of COCl at the proposed effluent limitations will not result in groundwater degradation. <br /> 10. By 2 January 2004, the Discharger shall submit a Vadose Zone Monitoring Device Installation <br /> Report prepared in accordance with, and including the items listed in, the second section of <br /> Attachment B. <br /> 11. By 17 June 2004, the Discharger shall submit a Wastewater Pretreatment Design Report. The <br /> report shall include an implementation schedule for pretreatment activities. The improvements <br /> must reduce COCs to concentrations that are protective of soil quality and do not degrade <br /> groundwater. The design report shall include an evaluation of the need for wastewater storage <br /> during times when climatic conditions prevent wastewater discharge. The report shall include a <br /> proposed schedule for all management changes and physical improvements. <br /> 12. By 19 August 2004, the Discharger shall submit a Report of Waste Discharge that describes the <br /> facility, wastewater generation, planned expansions to the facility, wastewater treatment, and <br /> groundwater quality. Attachment C provides minimum information requirements for the report of <br /> waste discharge technical report requirements; however, additional information shall be provided <br /> as necessary to describe the facility's wastewater system. <br /> In accordance with California Business and Professions Code Sections 6735, 7835, and 7835.1, <br /> engineering and geologic evaluations and judgments shall be performed by or under the direction of <br /> registered professionals competent and proficient in the fields pertinent to the required activities.
