The most recent series of complaints began in late July 2005; the <br /> frequency of the complaints has recently increased and staff inspected the facility on 20 September 2005. <br /> Staff's inspection confirmed the presence of objectionable odors at Mokelumne River Resort and <br /> determined the source of the odors at the time of the inspection was the one-acre Geohring Pond. <br /> An inspection report and photograph log is attached. <br /> Generation of odors is a violation of California Concentrate's WDRs Discharge Specification No. B.2, <br /> which states: <br /> Objectionable odors originating at this facility shall not be perceivable beyond the limits of <br /> the property owned by the Discharger. <br /> Historic Odor Generation Issues <br /> Nuisance odors have been a recurring problem at California Concentrate. In 1987, the Regional Board <br /> adopted a$5,000 Administrative Civil Liability Order(ACLO) for generation of odors and failing to <br /> submit a technical report to correct the problem. Despite adoption of an ACLO, California Concentrate <br /> continued to generate odors and Cleanup and Abatement Order No. 96-707 was adopted on 1 May 1997 <br /> in part, for continuing odor conditions. <br /> The Regional Board received odor complaints on 23 December 2004. At that time, staff was informed <br /> that both mechanical aerators had been removed from the pond. A 27 December 2004 Notice of <br /> Violation(NOV) required the aerators to be immediately repaired and placed in the pond in an operable <br /> condition. <br /> Odors were again reported in April 2005. Staff inspected the facility from the adjacent Mokelumne <br /> River Resort and determined objectionable odors were being generated by California Concentrate. On <br /> 21 April 2005, an NOV and California Water Code Section 13267 Order for Technical Reports was <br /> issued by the Executive Officer requiring a technical report describing the installation of adequate <br /> California Environmental Protection Agency <br /> 0 Recycled Paper <br />
