As you are aware, additional work is necessary to <br /> satisfactorily meet the requirements of the California Regional <br /> Water Quality Control Board. <br /> I am enclosing a letter written March 4, 1991 to the Board by <br /> our Environmental Engineer, Ron Bock. Phase I specifically <br /> describes the procedural action steps involved in the project. <br /> Unocal obviously must first obtain formal permission from Stone <br /> Brothers and Associates to access subject property before Phase <br /> I can begin. <br /> Unocal shall indemnify, defend, protect and hold Stone Brothers <br /> and Associates harmless from and against any and all claims, <br /> loss, proceedings, damages, causes of action, liability, cost of <br /> expense ( including attorney' s fees) arising from or in <br /> connection with or caused by any negligence of Unocal, its <br /> employees or independent contractors, or agents in connection <br /> with entering the property and performing tests, sampling, <br /> monitoring, and treating of the soil and/or groundwater .,on the <br /> property. In addition, Unocal agrees to accept full <br /> responsibility for repair and total restoration of site <br /> facilities damaged as a result of the subsurface sampling <br /> activity. <br />
