Mr. Bob Boust • 2. • 24 August 2000 <br /> Mr. Ed Koberstein <br /> Section 13304 of the California Water Code gives the Regional Board the authority to require that an <br /> alternative water source be supplied in place of one that has been impacted by an unauthorized release of <br /> petroleum hydrocarbons. Section 13304 states in part: <br /> "Any person who has discharged or discharges waste into the waters of the state in violation of any <br /> waste discharge requirement or other order or prohibition issued by a regional board or the state <br /> board,...shall upon order of the regional board, clean up the waste or abate the effects of the waste,... " <br /> In light of the above,Unocal and Montgomery Ward jointly are to: <br /> 1. Contact and cooperatively work with Delta staff,by 28 August 2000, to coordinate, assist, and <br /> implement all necessary planning, design, construction and startup activities as required to <br /> immediately supply an adequate alternative water source for the RIW. <br /> 2. By 1 September 2000, unless otherwise approved by Regional Board staff, have in-place and <br /> active, an alternative water source that is capable of supplying the demand previously required of <br /> the RIW. <br /> 3.
