On 24 April 2001 a revised MRP was issued to <br /> r, The Wine Group. <br /> On 15 September 2003, the CRWQCB issued a Notice of Violation (NOV) (CRWQCB, 2003)to <br /> The Wine Group for violating the Groundwater Limitations contained in WDR Order No. 95-097. <br /> In particular, the CRWQCB indicated in the NOV that land application of wastewater might have <br /> resulted in elevated concentrations of the following constituents of concern in Facility <br /> groundwater monitoring wells: <br /> • Electrical conductivity (EC) <br /> • Total dissolved solids (TDS) <br /> • Magnesium (Mg) <br /> • Sodium (Na) <br /> • Chloride (CI) <br /> • Nitrate as nitrogen (NO3 as N) <br /> • Sulfate (SO4) <br /> The NOV ordered the preparation and submittal of a Groundwater Degradation Evaluation <br /> Report to confirm whether or not the discharge from the Facility is degrading groundwater. <br /> On 29 December 2003, The Wine Group submitted a report titled Preliminary Groundwater <br /> Evaluation Report for the Wine Group, Franzia Winery(Kennedy/Jenks, 2003). The report <br /> suggested there may be a correlation between the area where winery process wastewater is <br /> applied and elevated levels of constituents of concern in the groundwater downgradient of that <br /> area. The report provided a conceptual plan for conducting additional data collection and <br /> analysis, and for the preparation of a wastewater treatment system and management <br /> improvement plan. <br /> On 27 April 2004, the CRWQCB issued CAO No. R5-2004-0704 (CRWQCB 2004)to The Wine <br /> _ Group. The CAO specifies that The Wine Group must comply with WDR Order No. 95-097 and <br /> MRP Order No. 95-097 (except for Groundwater Limitations during the study period). Item 2 of <br /> the CAO specifies that The Wine Group must submit a Groundwater Protection Work Plan by <br /> 21 June 2004. Items 3 through 6 of the COA specify that The Wine Group must submit a <br /> Monitoring Well Installation Report, a Groundwater Characterization Report, a Wastewater <br /> _. Characterization and Wastewater Treatment Evaluation Report, and a Report of Waste <br /> Discharge. <br /> 1.2 Site Location and History <br /> The Facility is located at 17000 East Highway 120 in Ripon, San Joaquin County, California. <br /> (Figure 1). The Facility consists of a total of approximately 392 acres located in Section 4, <br /> Township 2S, Range 8E (Mount Diablo Base & Meridian).
