PUBLIC HEALTH SERVICES
SAN JOAQUIN COUNTY Q
JOGI KHANNA M.D.,M.P.H.
Health Officer
P.O. Box 2009 • (1601 East Hazelton Avenue) Stockton,California 95201
c9iFORP
MAR 12 1991 (209) 468-3400
CHRIS BRAMER
SIERRA ENVIRONMENTAL SERVICES
P O BOX 2546
MARTINEZ CA 94553
RE: Chevron Station #9-6171 IN REPLY REFER TO SITE CODE: 1784
6633 Pacific Ave.
Stockton
Public Health Services, Environmental Health Division (PHS/EHD) is in receipt of your January 22, 1991,
letter which addresses issues outlined in a PHS/EHD letter written to Mr. Clint Rogers of Chevron on
January 3, 1991. Your letter will be placed in the file thereby allowing the response to become a permanent
part of the record. This letter will serve as a final response to this particular set of circumstances.
PHS/EHD's file indicates that the site geologist's response, when questioned on authorization to work on
Sunday without required inspections, was that he tried to contact our office late on Friday but was unable
to reach anyone. When a regulatory agency's ability to conduct its inspection is eliminated, so is its
responsibility to recognize the results of the unauthorized activity.
Although not relevant to the primary issue, but to more completely respond to your letter,PHS/EHD would
like to take this opportunity to add a few other comments.
Sierra Environmental Services' standard operating procedures with regard to the handling of OVM samples
reflects a variance from the general industry standard. Other consulting firms remove the soil from the brass
tubes into a zip lock type plastic bag, seal the bag, then expose it to the sunlight to promote volatization.
When ready to obtain a reading, the seal is then opened slightly to allow the probe to be inserted. This
method might eliminate future confusion between lab samples and OVM samples.
As a final note, PHS/EHD does not currently, or at the time of the incident, employ anyone by the name of
"Melanie" and the only "Ron" is the executive director of the Environmental Health Division. Mr. Valinoti
does not perform staff level functions such as inspections.
If you have any other questions or concerns, you may contact Steven Schneider, REHS at (209)468-3441.
Jogi Khanna, .D:, M.P.H.
Health Officer
Laurie A.
