Your letter will be placed in the file thereby allowing the response to become a permanent <br /> part of the record. This letter will serve as a final response to this particular set of circumstances. <br /> PHS/EHD's file indicates that the site geologist's response, when questioned on authorization to work on <br /> Sunday without required inspections, was that he tried to contact our office late on Friday but was unable <br /> to reach anyone. When a regulatory agency's ability to conduct its inspection is eliminated, so is its <br /> responsibility to recognize the results of the unauthorized activity. <br /> Although not relevant to the primary issue, but to more completely respond to your letter,PHS/EHD would <br /> like to take this opportunity to add a few other comments. <br /> Sierra Environmental Services' standard operating procedures with regard to the handling of OVM samples <br /> reflects a variance from the general industry standard. Other consulting firms remove the soil from the brass <br /> tubes into a zip lock type plastic bag, seal the bag, then expose it to the sunlight to promote volatization. <br /> When ready to obtain a reading, the seal is then opened slightly to allow the probe to be inserted. This <br /> method might eliminate future confusion between lab samples and OVM samples. <br /> As a final note, PHS/EHD does not currently, or at the time of the incident, employ anyone by the name of <br /> "Melanie" and the only "Ron" is the executive director of the Environmental Health Division.
