II-GENERAL PERMIT CONDITIONS <br /> A. REFERENCES AND TERMINOLOGY <br /> This Permit is issued by the U. S. EPA, Region IX to the Defense <br /> Logistics Agency--Distribution Region Vest--Sharpe Site <br /> (DDRW--Sharpe) for hazardous waste storage at Buildings 530 and 605. <br /> The Permittee is DDRY--Sharpe, operator of Buildings 530 and 605. <br /> The owner of the facility, is Defense Logistics Agency--DDRY--Sharpe. <br /> The Director is the Director of the Hazardous Waste Management <br /> Division, EPA, or his duly authorized representatives. <br /> The Solid Waste Disposal Act, as amended by the RCRA of 1976, as <br /> amended (42, USC, Section 6901, et seq. ) and the Hazardous and Solid <br /> Waste Amendments of 1984 (HSWA) , is referred to in this Permit as <br /> RCRA. <br /> Sections in Title 40 of the Code of Federal Regulations (CFR) are <br /> cited as 40 CFR (section number) . The regulatory authority for each <br /> condition is cited in brackets in appropriate locations within each <br /> condition, except that in Part V, the statutory and regulatory <br /> authority is cited in condition V.A. <br /> The "Hazardous Waste Facility Operations Plan' , dated March 8, 1990, <br /> and revised November 15, 1990, is referred to in this Permit as the <br /> Part B Application. <br /> Unless explicitly defined, terminology used in this Permit is defined <br /> in 40 CFR 260.10, 264.141, 268.2 and 270.2. <br /> B. EFFECT OF PERMIT <br /> The Permittee is permitted to store hazardous waste in accordance <br /> with the conditions of this Permit. Any storage of hazardous wastes <br /> not authorized in this Permit is prohibited. Subject to 40 CFR <br /> 270 . 4 , compliance with this Permit constitutes compliance, for <br /> purposes of enforcement, with Subtitle C of RCRA. Issuance of this <br /> Permit does not convey property rights of any sort, or any exclusive <br /> privilege; nor does it authorize any injury to persons or property, <br /> any invasion of other private rights, or any infringement of federal, <br /> state or local law or regulations. Compliance with the terms of this <br /> Permit does not constitute a defense to any order issued or any <br /> action brought under Sections 3008(a) , 3D08(h) , 3013 or 7003 of RCRA; <br /> Sections 106(a) , 104 or 107 of the CERCLA, or any other law governing <br /> protection of public health or the environment for any imminent and <br /> substantial endangerment to human health or the environment.
