(2) The report summary, complies with the requirements specified <br /> in II.G.3(c) . [40 CFF 270.32(b) (2)] <br /> g. The Permittee shall submit a copy of all plans, plan summaries, <br /> reviews and plans , reports and report summaries required by <br /> Permit Conditions II.G.2 and 3 above, to the Director on or <br /> before October 1, 1991. [40 CFR 270.32(b) (2)3 <br /> The Director may require the facility to submit a more detailed <br /> status report for a specific waste minimization project if the <br /> reasons for such project is unclear. <br /> H. RESPONSIBILITIES AND REQUIREMENTS <br /> 1. Duty to Comply <br /> The Permittee shall comply with all conditions of this Permit, <br /> except to the extent and for the duration such noncompliance is <br /> authorized by an emergency permit. Any Permit noncompliance, <br /> except under the terms of an emergency permit, constitutes a <br /> violation of RCRA and is grounds for enforcement action, Permit <br /> termination, revocation and reissuance, modification or denial of <br /> a permit renewal application. 140 CFH 270.30(a) and 270.51(c) ] <br /> 2. Duty to Reapply <br /> If the Permittee wishes to continue an activity regulated by this <br /> Permit after the expiration date of this Permit, the Permittee <br /> shall apply for and obtain a new Permit. Such application must <br /> be submitted to the Director at least one hundred and eighty <br /> (180) calendar days before this Permit expires and shall include <br /> all information set forth in 40 CFR 270.13, 270.14, 270.15 and <br /> 270.16. If this Permit is modified before it expires to include <br /> surface impoundments, waste piles, incinerators, land treatment <br /> units, or landfills, miscellaneous units or other hazardous waste <br /> management units which may be regulated by 40 CFR 264 in the <br /> future, the Permittee shall also provide information set forth in <br /> 40 CFR 270 . 17 , 270 .18 , 270 . 19 , 270 . 20 , 270 . 21 and 270 . 23 , <br /> respectively. The Permittee shall keep records of all data used <br /> to complete Permit applications and any supplemental information <br /> for a period of at least three years from the date the Permittee <br /> signs the application. [40 CFR 270.10(a) , 270.10(d) , 270.10(h) , <br /> 270.10(i) , 270.21 and 270.30(b)] <br /> 3. Permit Expiration <br /> As long as EPA is the permit-issuing authority, this Permit and <br /> all conditions herein will remain in effect beyond the Permit' s <br /> expiration date-, if the Permittee has submitted -a -timely , - - <br /> complete application (see 40 CFR 270.10, 270.13 through 270.29) <br /> and, through no fault of the Permittee, the Director has not <br /> issued a new Permit, as set forth in 40 CFR 270.51. <br /> 9 <br />
