Ms. Diane Hinson
October 23, 1992
Page Two
requirements, criteria, or limitations as those terms are used
inthe Comprehensive Environmental Response, Compensation, and
Liability Act (CERCLA) Section 121 (d) (2) and as further defined
in the National Contingency Plan, 40 CFR Section 300. 5.
Types of ARARs include action-specific, site-specific, and
chemical-specific ARARs. Action-specific ARARs are usually
technology or activity based requirements or limitations on
actions taken with respect to hazardous wastes. Site-specific or location-specific ARARs
are usually restrictions placed on the concentrations of
hazardous substances or the conduct of activities solely because
they occur in special locations (i.e. , wetlands, etc. ) .
The Department requests your ARAR determination as soon as
possible, or at least by December 14 , 1992 .
