k. At the completion of the grading, the applicant shall have a registered civil engineer or <br /> licensed land surveyor compare the excavation's final elevations with the approved permit. <br /> The engineer or surveyor shall submit a certified written finding to the Community <br /> Development Department which states and documents the compliance or noncompliance <br /> of the excavation with all of the conditions of the approved permit, including <br /> documentation that fertilization has been completed per the laboratory recommendations <br /> submitted by the applicant. (Planning Title Section 9-2224(k)) <br /> I. To insure that the excavation is completed in conformance with the approved permit, th <br /> operator shall secure a performance bond or other financial security sufficient to cov r <br /> the cost of rehabilitation of the site for agricultural use. The form of the bond or oth r <br /> financial security shall be found acceptable by County Counsel. (Planning Title Sectio <br /> 9-9994(M)) <br /> M. The applicant shall not be required to replace the site's topsoil, and excavated materiI <br /> may be removed from the site without stockpiling following the County's acceptance f <br /> the performance guidelines. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a. No excavation or stockpile shall be allowed within 25 feet of the right-of-way line of Austi <br /> Road. (Planning Title Section 9-2224(m)(1)) <br /> 3. PUBLIC HEALTH SERVICES: <br /> a. No excavation is permitted into the ground water table without specific approval from th <br /> Regional Water Quality Control Board, Central Valley Region. (Porter-Cologne Water <br /> Quality Control Act, Chapter 4, Article 3, Section 13240) <br /> b. The materials from an excavation shall not be deposited into any water course nor in ar!y <br /> way contribute to the pollution thereof. (California Water Code Section 13376) <br /> C. Provide approved sanitary facilities for all employees. (Ordinance Code Section 5-3001) <br /> 4. SOUTH SAN JOAQUIN IRRIGATION DISTRICT: <br /> a. The land owner shall agree not to perform any excavation or grading within the South <br /> San Joaquin Irrigation District easement or within 15 feet of the centerline of the pipeline, <br /> whichever is greater. <br /> b. Excavations adjacent to District easements and/or facilities shall have a minimum 3:1 <br /> slope from the excavated field to the top of the berm. <br /> C. The land owner will take such steps as are required by the District's Watr <br /> Superintendent to remedy any erosion on banks adjacent to the District's facilities. <br /> d. No soil will lie stockpiled over the District's pipeline. <br /> e. No heavy equipment will travel over the District's pipeline without approved bridgin , <br /> which is to be approved by the District and the contractor. <br /> Amended Conditions - 2 - GX-92 9 <br />
