k. At the completion of the grading, the applicant shall have a registered civil engineer or licensed land surveyor compare the excavation's final elevations with the approved permit. The engineer or surveyor shall submit a certified written finding to the Community Development Department which states and documents the compliance or noncompliance of the excavation with all of the conditions of the approved permit, including documentation that fertilization has been completed per the laboratory recommendations submitted by the applicant. (Planning Title Section 9-2224(k)) I. To insure that the excavation is completed in conformance with the approved permit, th operator shall secure a performance bond or other financial security sufficient to cov r the cost of rehabilitation of the site for agricultural use. The form of the bond or oth r financial security shall be found acceptable by County Counsel. (Planning Title Sectio 9-9994(M)) M. The applicant shall not be required to replace the site's topsoil, and excavated materiI may be removed from the site without stockpiling following the County's acceptance f the performance guidelines. 2. DEPARTMENT OF PUBLIC WORKS: a. No excavation or stockpile shall be allowed within 25 feet of the right-of-way line of Austi Road. (Planning Title Section 9-2224(m)(1)) 3. PUBLIC HEALTH SERVICES: a. No excavation is permitted into the ground water table without specific approval from th Regional Water Quality Control Board, Central Valley Region. (Porter-Cologne Water Quality Control Act, Chapter 4, Article 3, Section 13240) b. The materials from an excavation shall not be deposited into any water course nor in ar!y way contribute to the pollution thereof. (California Water Code Section 13376) C. Provide approved sanitary facilities for all employees. (Ordinance Code Section 5-3001) 4. SOUTH SAN JOAQUIN IRRIGATION DISTRICT: a. The land owner shall agree not to perform any excavation or grading within the South San Joaquin Irrigation District easement or within 15 feet of the centerline of the pipeline, whichever is greater. b. Excavations adjacent to District easements and/or facilities shall have a minimum 3:1 slope from the excavated field to the top of the berm. C. The land owner will take such steps as are required by the District's Watr Superintendent to remedy any erosion on banks adjacent to the District's facilities. d. No soil will lie stockpiled over the District's pipeline. e. No heavy equipment will travel over the District's pipeline without approved bridgin , which is to be approved by the District and the contractor. Amended Conditions - 2 - GX-92 9
