The basis for their claim was that only used oil which <br /> met the specifications of SB 86 would be recycled , therefore , n <br /> "hazardous waste " would be processed at the facility. The pro- <br /> posed method for making this determination would be to conduct <br /> tests for SB 86 compliance prior to off-loading used oil delive ed <br /> to the facility . Any used oil not meeting SB 86 requirements <br /> would either be returned to the source or sent to an authorized <br /> facility . <br /> It is our understanding that used oil (whether it meets SB 86 <br /> criteria or not) is classified as a hazardous waste , and that a y <br /> facility which would process used oil is subject to Tanner. <br /> Pursuant to Section 25199 . 3 (d ) of the Health and Safety Code , S n <br /> Joaquin County hereby requests technical assistance from your <br /> office in determining whether or not the Falcon Energy project s <br /> subject to the provision of AB 2948 . <br /> We would appreciate a response prior to August 24 , 1989 , which S <br /> the date of the public hearing before the San Joaquin County <br /> Board of Supervisors on the appeal of Falcon Energy Associates f <br /> the denial of the use permit by the Planning Commission . <br />
