2. Manifest Discrepancies (off-site) <br /> a. Significant Discrepancies <br /> (1) Upon discovering a significant discrepancy <br /> between the quantity or type of hazardous waste <br /> designated on the manifest and the quantity or <br /> type of hazardous waste the facility actually <br /> receives, the owner or operator shall attempt to <br /> reconcile the discrepancy with the waste <br /> generator or transporter. <br /> (2) Significant discrepancies in quantity are: <br /> (a) For bulk waste, variations greater than ten <br /> percent in weight; and <br /> (b) For batch waste, any variation in piece <br /> count such as a discrepancy of one drum in a <br /> truckload. <br /> (3) Significant discrepancies in type are obvious , <br /> differences which can be discovered by inspections <br /> or waste analysis, such as waste solvent for <br /> waste acid or toxic constituents not reported on <br /> the manifest. <br /> b. If the facility cannot legally accept the waste, the , <br /> owner or operator shall immediately notify the <br /> Department of that fact, identify the transporter and , <br /> generator of the waste, and refuse to accept the ' <br /> waste. If the owner or operator can accept the waste, ' <br /> the owner or operator shall note how the discrepancy <br /> was resolved on the copy of the manifest submitted to <br /> the Department and on the copy retained at the. <br /> facility. If the discrepancy is not resolved within, <br /> 15 days after receiving the waste, the owner or <br /> operator shall immediately submit to the Department <br /> letter describing«'t^he, discrepancy and attempts t <br /> reconcile it and a7%copy .of' t-he Manifest at issue. <br /> 3. Unmanifested Wastes,,4,..Received: ,or.
