APPEAL STATEMENT: <br /> 'The internal consistency of the General Plan is maintained in the adoption of the amendment.' <br /> RESPONSE: <br /> Establishing a new Limited Agriculture area must be consistent with the following General Plan <br /> policy: "The Limited Agriculture land use designation will be considered in areas of small scale <br /> agricultural operations where the parcels are generally between 5 and 10 acres in size outside <br /> of areas planned for urban development and in areas zoned AL-5 and AL-10 as of the adoption <br /> of this Plan.' <br /> The proposed reclassification must also be consistent with specific General Plan Agricultural <br /> Lands Objectives regarding the protection of agricultural lands needed for the continuation of <br /> commercial agricultural enterprises. <br /> Approval of the applications would be inconsistent with the intents of both the AG and AL zones, <br /> because a new area of small-scale agricultural parcels would be created and the area <br /> surrounding the project site containing existing commercial agricultural enterprises would be <br /> disrupted. <br /> In addition, the requests of those adjacent to this area to have their property added to the <br /> proposal show that creating a new Limited Agriculture area would result in pressures to expand <br /> it further. <br /> 2. APPEAL STATEMENT: <br /> "The proposed zone district is consistent with the General Plan.' <br /> RESPONSE: <br /> The proposed AL-5 zone is one of the implementing zones for the Limited Agriculture General <br /> Plan designation as indicated in Table VII-1 of Volume I of the General Plan. <br /> 3. APPEAL STATEMENT: <br /> 'The proposed zone is reasonable and beneficial at this time.' <br /> RESPONSE: <br /> It is difficult to show that this proposal, which creates a new area zoned AL-5 and allows for the <br /> subdividing of additional agricultural land, is advantageous; nor can it be shown to be timely, <br /> given the recent adoption of a new General Plan. <br /> 4. APPEAL STATEMENT: <br /> 'There will be a continuing agricultural use required under the AL zone.' <br /> Establishing a new AL zone will result in the possibility of a 16.37 acre parcel being subdivided <br /> for three additional homes, resulting in lessened agricultural viability for that parcel. <br /> 5. APPEAL STATEMENT: <br /> 'The site history documents the sub-standard production from the existing cherry orchard and the <br /> inability for improvement.' <br /> BOS LETTER PAGE 2 <br />
