PLANNING COMMISSION MINUTES <br /> NOVEMBER 5, 1992 <br /> 4 . GENERAL PLAN MAP AMENDMENT APPLICATION NO. GP-92-12 AND ZO E <br /> RECLASSIFICATION APPLICATION NO. ZR-92-14 OF SAN JOAQUIN COUNTY o <br /> amend the General Plan and reclassify 37 acres from General <br /> Agriculture/AG-40 (40-acre minimum parcel size) to Limitd <br /> Agriculture/AL-5 (5-acre minimum parcel size) . The project site s <br /> located on the east side of Ashley Lane, south of the Calaver s <br /> River, approximately 1, 130 feet north of Cherokee Road, northea t <br /> of Stockton (Supervisorial District 4) . <br /> Associate Planner Mary Bava introduced a staff report into the <br /> record. She said that letters had been received in opposition and <br /> have been included in the staff report packet. She said that oth r <br /> letters had been received this week by the department requesti g <br /> that their properties be included in the project applications. <br /> Comms. Carter and Jungeblut noted that they had viewed the <br /> property. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Attorney Mike Hakeem (2800 W. March Lane, Suite 20 , <br /> Stockton) was present for Bob and Barbara Byington, owners of 16.if <br /> 7 <br /> acres within the project area. Mr. Hakeem gave the history of te <br /> Byington request, as explained in the staff report. He said tht <br /> the Byingtons have tried to grow cherries on the property; out <br /> the 3 , 000 trees they planted, 2 , 000 died and the rest were stunted. <br /> The U.C. Agricultural Extension Service studied the property and <br /> indicated that nothing could be done to improve the orchard. M37. <br /> and Mrs. Byington have worked the property for 20 years without a <br /> return on their capital. Mr. Hakeem said that the Board f <br /> Supervisors felt that the Byingtons made an effort to have n <br /> agricultural use of the property. The Board denied, withot <br /> prejudice, the Byingtons' application for AL-5 zoning and referr d <br /> the matter back to the Commission for reconsideration of n <br /> expanded area. The three proposed lots for the Byington proper y <br /> are. for estate planning for their children. <br /> Amedeo J. Nicora (7113 E. Cherokee Rd. ) said he is in favor of t e <br /> proposal and wants to be included. He said he planted his cher y <br /> orchard three times and lost the orchard three times. He said h s <br /> letter is on file. He wants to give each of his two sons a parc 1 <br /> of land. The home in which his sons were born has been in t e <br /> family for three generations. His property would fill in the are . <br /> Julia DiCarlo, representing Larry Celle (14175 E. Highway 2 , <br /> Linden) , asked to be included in the application. Mr. Celle h s <br /> owned his ranch for a number of years. There is nc intent o <br /> subdivide it. Mr. Celle has three grandchildren and some time n <br /> the future he would like to turn this land over . to his gra d <br /> children.
