Attorney Christopher Green (509 W. Weber Ave. , Stockton) , repr - <br /> senting property owners on both sides of Cherokee (37 acres and El <br /> acres) , belonging to San Tomo Partners and G & W Farms, who wart <br /> their properties to be included in the application. He suggested <br /> a continuance of the hearing to study the possibility of expandi g <br /> the area. <br /> Director Chet Davisson said that with relation to this study area, <br /> the County just finished a two-year program. The requests for <br /> expansion of the area do not meet the General Plan and AL-5 zoning <br /> criteria. <br /> OPPONENTS: Bruce Blodgett, representing the San Joaquin Fa m <br /> Bureau, said that his concerns were expressed in his letter which <br /> is on file. He said that agricultural land should not have AL- 5 <br /> zoning; the AL-5 zoning would encourage development of the are , <br /> and this is borne out by the requests for expansion of the zonin . <br /> He said the County just went through the General Plan study for <br /> this area. A 5-acre parcel is too small for a commercial agricul- <br /> tural operation. More land has been designated for growth in the <br /> 2010 Plan than is actually needed. <br /> REBUTTAL: Mr. Hakeem said that the Commission should look at tie <br /> AL-5 Policy. That designation is for areas that are appropria e <br /> for small-scale agricultural operations, where parcels are 5- aid <br /> 10-acres in size. The Byington property is surrounded by tho e <br /> parcel sizes. He said this matter was sent back to the Planning <br /> Commission to draw a boundary. The Board did not deny the Byingt n <br /> request. This is not a study area. The people in the area want to <br /> bring in another 150 acres. <br /> PUBLIC HEARING CLOSED <br /> Comm. Gillispie said that 5-acre parcels are homesite parcels and <br /> not agricultural parcels, but are for country estates. He said lie <br /> could make a case for the consideration of AL-5 zoning for the <br /> northern parcels. <br /> Comm. Morri said there is a church on one of the sites. He said lie <br /> could draw some boundaries at this time. <br /> MOTION: Moved, seconded (Gillispie-Jungeblut) and carried by a <br /> vote of 4-2 to: <br /> 1. Approve the Negative Declaration; and <br /> 2 . Deny General Plan Amendment Application No. GP-92-12 and Zo e <br /> Reclassification Application No. ZR-92-14 . <br /> VOTE: <br /> AYES- JUNGEBLUT, HOLLY, GILLISPIE, CARTER <br /> NOES- MORRI, ROJAS <br /> ABSENT- BOZZANO <br /> ----------------------------------------------------------------- - <br /> -3- <br />
