VR-92-6 OF i <br /> KENNETH NORGAARD (C/O DILLON ENGINEERING) <br /> The request is for a Variance application to decrease the minimum <br /> required parcel size in the AG-40 zone from 40 acres to thirty <br /> acres. The underlying project, which has not been submitted <br /> pending action on the Variance application, is expected to be a <br /> Minor Subdivision application to create a 30-acre and a 40-acre <br /> parcel from the existing 70-acre parcel. <br /> The Development Services Division has reviewed the above-referenced <br /> Variance application and will recommend to the Planning Commission <br /> that it be denied based upon the inability to make the following <br /> required Findings: <br /> Because of the special circumstances applicable to the property, <br /> including size, shape, topography, location or surroundings, the <br /> strict application of the zoning regulation deprives the property <br /> of privileges enjoyed by other property in the vicinity and under <br /> identical zoning classification. <br /> -This Finding cannot be made because there are no special <br /> circumstances applicable to the property; its shape, size, and <br /> topography are essentially the same as other properties in the <br /> vicinity with the same zoning designation. <br /> The granting of the Variance will not constitute a grant of special <br /> privileges inconsistent with the limitations upon other properties <br /> in the vicinity and zone in which the property is situated. <br /> -This Finding cannot be made because the granting of the Variance <br /> will allow further subdivision of the property and the construction <br /> of an additional residence on the property; neither of which ale <br /> permitted for owners of other properties in the vicinity with the <br /> same zoning designation. <br />
