Weber Avenue, Stockton CA 95202 <br /> (209)468-3962 <br /> Name of Investigator(s)- <br /> Robert <br /> nvestigator( lRobert Lopez, OES (209)468-3969 <br /> IVALLEGED i FGFD VIOLATIONS <br /> Health & Safety Code(HSC) 25189.5 The disposal of any hazardous waste, or the'causing thereof, <br /> is prohibited when the disposal is at a facility which does not have a permit from the department <br /> issued pursuant to this chapter,or at any point which is not authorized according to this chapter. <br /> ->Hazardous waste was observed on the ground in various locations. <br /> California Code of Regulations (CCR) 66265.31 Facilities shall be maintained to minimize the <br /> possibility of a fire, explpsion, or any unplanned sudden or non-sudden release of hazardous <br /> waste or hazardous constituents to air, soil, or surface water which could threaten human health <br /> or the environment. <br /> ->Facility was not properly maintained. <br /> HSC 25201(a) 25201 Except as provided in subdivisions (c) and (d), no owner or operator of a <br /> storage facility, treatment facility, transfer facility, resource recovery facility, or disposal site <br /> shall accept, treat, store, or dispose of a hazardous waste at the facility, area, or site, unless the <br /> owner or operator holds a hazardous waste facilities permit or other grant of authorization from <br /> the department <br /> to use and operate the facility, area, or site, or the owner or operator is operating under a permit- <br /> by-rule pursuant to the department's regulations, or a grant of conditional authorization or <br /> conditional exemption pursuant to this chapter. <br /> -> This facility stored hazardous waste on site longer than 180 days without authorization. <br /> CCR 66262.34 (t)(3) Each container and tank used for onsite accumulation of hazardous waste <br /> shall be labeled or marked clearly with the words, "Hazardous Waste."Additionally, all <br /> containers and portable tanks shall be labeled with the following information: <br /> (A) composition and physical state of the wastes <br /> (B) statement or statements which call attention to the particular hazardous properties of the <br /> waste <br /> Page 4 of 6 <br />
