Inc. * 000557 <br /> 1766 Monte Diablo Ave. <br /> Stockton, CA 95203 <br /> Please find enclosed the materials that were requested per our conference call on <br /> July 21 . This call was in regard to my Inability to ascertain funds from the <br /> Department of Commerce to remove the underground storage tanks located at 1766 <br /> Monte Diablo Ave. This call was conducted by: Susan Phillips, Team Leader for the <br /> State Water Resources Control board, Mr. Calvin Young from the Department of <br /> Commerce, and Russell F. Chapin legal owner of the property. <br /> In an attempt to comply with San Joaquin County environmental requlations and <br /> therefore stay eligible for the underground storage tank cleanup fund program (SB <br /> 2004), 1 have tried to acquire a loan from the Dept. of Commerce to lift the <br /> underground gasoline storage tanks located at said site. After several months of <br /> fervent discussions and a change of Directors, the Dept. of Commerce refuses to <br /> allow my application for the funds until the property is determined to be free of <br /> contamination or we bond the loan with personal assets. <br /> Due to the Dept. of Commerce's position regarding these funds, we find ourselves <br /> In a precarious position concerning our responsibilities for the remediation of the <br /> contaminated site. <br /> The problem which has surfaced is that a tank removal permit was paid to San <br /> Joaquin County and a request for an extension of our tank removal permit was <br /> submitted June 3, 1992. Due to my inability to secure funds and start the tank <br /> removal process, these permits are in jeopardy of expiring. Therefore, we risk the <br /> possibi Iity of losing the $1 ,100 for the cost of the permits, violating county <br /> environmental ordinances, and more importantly being removed from the State's <br /> underground storage tank cleanup fund program. <br /> 1 <br />
