ACCOMPLISHMENTS: <br /> The release of petroleum was stopped and the source of contamination (tanks) <br /> removed. Risk to public health and safety was reduced to insignificant levels <br /> The engineering firm ATC associate. We have removed tons of dirt from site and <br /> treated 12 MILLION GALLONS of water, used all the available technique available <br /> (BAT) including air-sparging Vapor extraction According to our present engineering <br /> firm (AGE) removed 95% of the contamination. <br /> Our present engineering firm Advanced Geo Environmental Inc (GEO) advises we <br /> comply with the checklist of required data for closure of underground tank sites. Among <br /> the 16 items of concern being (11) Best Available Technology (BAT) used (12) Reason <br /> why "background was/is unattainable using BAT". (15) Rationale why conditions <br /> remaining at the site will not adversely impact water quality, health, or other beneficial <br /> uses; <br /> WHAT WE HAVE LEARNED DURING THIS PERIOD <br /> Administrative Concerns: <br /> Never a friendly environment our documents reflect an attitude more inclined to enforce <br /> than cooperate. This view is demonstrated by the action taken by environmental health <br /> (EVH) <br /> a. Filed complaint with the San Joaquin County District Attorney office. <br /> b. Authorize the action to have Chapin Bros removed from the USTR Fund. This <br /> action cannot be considered simply a communication problem. Our records of <br /> phone calls as well as our minutes of conference attempting to explain the delay <br /> caused by acquiring a small business loan to do the investigation and tank <br /> removal. <br /> c. Environmental Health's policy is not fair and balanced. Other sites in the County <br /> were closed even when other site was a lot hotter and more at risk to human <br /> health. Example SW corner of Acacia & Yosemite streets <br /> d. Goals and objectives were not properly defined, needs reviewing of articles of <br /> intent and purpose set out for list closure. Obviously the state is charged with <br /> this, however lacking local input. <br /> e. The mind-set of EVH as expressed many time "Cost is A NON-ISSUE". <br />
