Cleanup Unit <br /> I have received.your notice of intent to review the above case and offer any further <br /> information requested to better understand the basis for my Closure petition; this file <br /> begins in the mid 1990's and contains several hundred documents and is our second <br /> appeal. <br /> I believe the basic information is provided in the ATC Closure Report dated October 4, <br /> 2004. It is also prominent to establishing the pertinent facts-rationale for Closure that I <br /> cite and refer to: <br /> In appendix B of the Tri-Regional Recommendations Check List of required Data <br /> For Closure Of Underground Tank Sites "Closure Documents Application" (one <br /> through sixteen.) <br /> #14 Assumptions, Parameters, Calculations, and Model used in risk assessments, <br /> and fate and transport modeling. <br /> #15 Rationale, why conditions remaining at,the site will not adversely impact <br /> water quality, health, and other beneficial uses. <br /> As the title reads all are recommendations not the letter of the law Both items (14 & 15) <br /> are covered in ATC Associates response to San Joaquin Environmental Health (EHD) <br /> correspondence Regarding Request for Closure. <br /> It's no secret the Regional and County (EHD) are sitting on top off many million's of <br /> dollars of cleanup in Stockton. I believe that the root of all evil in California comes down <br /> to three resolutions established by the State Water Resources Control B"d dated in <br /> 1968, 1988, and 1992. <br />
