The following are Class II <br />(Repeat) violations: 20, 27, <br />and the following are Minor Violations - Notice to Comply: #7, 11, 23, 30, 50, <br />79, 83, 84, 85, 999 <br />7. Observed one 5 -gallon <br />bucket of anti -freeze and one 1 -gallon bottle of unknown liquid in the storage <br />room, absorbent pads on <br />the floor by the flying shear machine, and waste metal being recycled as scrap <br />metal without first determi <br />ing particle size or hazardous properties. Generator shall make hazardous <br />waste determination of the <br />waste and manage the waste accordingly. Hazardous waster and size of <br />metal particles must bedetermined <br />before they can be recycled as scrap metal. Particles 100 microns <br />or smaller must be handled <br />as hazardous waste if the metal is determined to be a hazardous waste. <br />Immediately make a haza <br />dous waste determination of the anti -freeze and one -gallon bottle, manage <br />each accordingly, or disp <br />se of the wastes as hazardous waste in accordance to California Code of <br />Regulations (CCR) Title 22. <br />In addition, immediately stop recycling metal fines, make a hazardous <br />waste determination for the <br />, and manage it according the Title 22 hazardous waste regulations. <br />Particles 100 microns or s <br />aller must be handled as hazardous waste if the metal is determined to be a <br />hazardous waste. Submit <br />a statement and supporting documentation explaining how these wastes were <br />managed by September 2 <br />2011. <br />11. Oil spillage was obse <br />ed around the flying shear machine. Facilities shall be maintained and <br />operated to minimize the possibility <br />of a fire, explosion, or release of hazardous waste to air, soil, or <br />surface water which could <br />threaten human health or the environment. Immediately clean up the above <br />waste and manage according <br />to Title 22 hazardous waste regulations. Submit a statement and <br />supporting documentation <br />explaining how this waste was managed by September 2, 2011. <br />20 (Repeat) & 50. One 55 <br />gallon drum of waste oil in the storage room has no hazardous waste property <br />on the label and has an accumulation <br />start date of 1/18/2011, and one blue 5 -gallon bucket of waste oil <br />and one 55 -gallon drum o <br />paint waste in the storage room has no hazardous waste label. All <br />hazardous waste containers <br />shall be marked with the following information: <br />1. the words "Hazardous <br />aste", 2. name and address of generator, 3. hazardous properties, <br />4. physical state, 5. composition <br />(contents), 6. accumulation start date <br />Immediately label these containers <br />and ensure that all containers are marked with all the required <br />information.
