Box 393 <br /> Thornton, CA 95686 <br /> Dear Ms. Lopez: <br /> SB 562 CLOSURE REVIEW DETERMINATION -26500 NOWELL ROAD, <br /> THORNTON - CLAIM NO. 9881 <br /> 1 have reviewed the documents submitted on your behalf by ENSR Consultants, dated February <br /> 16, 1998, requesting that the Underground Storage Tank Cleanup Fund (Fund) Manager review <br /> your case for closure under authority of Senate Bili 562. In addition to review of the documents <br /> submitted with your request, your Fund claim file has also been reviewed. Also, your case has <br /> been discussed with staff of the San Joaquin County Health Department (SJCHD),jurisdictional <br /> oversight agency for the subject claim. Based on review of all information submitted, and the <br /> discussions with the SJCHD, I find that it is premature at this time to consider your request. The <br /> submittal of a standard closure request document, required of all responsible parties by SJCHD, <br /> requesting closure is necessary in order for SJCHD to complete their review of your site for <br /> closure consideration. <br /> Review of the submitted information and the Fund file has revealed that your site is a candidate <br /> for low risk closure. Also, discussion with SJCHD have indicated that your request for closure <br /> has not been formally denied, rather they (SJCHD) have requested the submittal of a standard <br /> closure request document. The SJCHD's request was conveyed to you in a letter dated February <br /> 3, 1997, which I have enclosed with this letter for your benefit. I feel that the request for the <br /> aforementioned closure request document to be reasonable and necessary. In addition, the efforts <br /> to prepare, submit, and interact with the SJCHD, specific to the requested closure document are <br /> eligible for Fund reimbursement. <br /> Following completion of the required closure request document, and based upon review of said <br /> document, the SJCHD have indicated that they will reconsider your request for closure. Should <br /> you continue to conclude that site closure is warranted, and are again denied closure, I will <br /> reevaluate your appeal for closure. <br /> Therefore, I recommend that you contact Ms. Margaret Lagorio, at(209)468-3449, regarding <br /> questions you or your consultant may have. <br /> California Environmental Protection Agency <br /> Recycled Paper <br />
