Weber Ave. a ,;,: ?Tc FL--ALTH
Stocktoq CA 95202 1 PL- .MJ/ :'sEHVIC-S
Fe:ARCO at highway 99 and Yosemite
cDcar Doug,
I am writing to express my concern about County policy with regard to an ARCO station that is not
licensed to operate under the December 22, 1998"Federal upgrade requirements. The unit in question is
located at Highway 99 and Yosemite in Manteca. it is still operating without a window stie ker. Why?
Our company has closed and demolished two units and have upgraded others at considerable expense. If
we could have operated these units alter the deadline, and avoided the costs of upgrades,we could have
saved hundreds of thousands of dollars. Welt we complied with the law. We gladly spent our money.
We are doing our clean-ups as quickly as the bureaucracy will move us.
What is this ARCO's story, are they in compliance? I would be in jail if I didn't comply with the law-
And on top of that my units would be closed. If this unit is out of compliance, shouldn't it be closed? T
only want what is fair.
I know that my fines would be$5,000 per day per tank plus$10,000 per delivery of fuel after the
compliance date. Are they working this out politically? Are they paying 100%of the fines? I compete
with them right down the street and to me they have a significant competitive advantage over me if they
have not taken the time to comply, and that is unfair! Are they going to be closed for weeks or months
doing upgrades? We have been. Every day over the.deadline they are open hurts all those who complied
and further hurts those who had to close.
T guess I don't understand the process. We all worked hard, we both sometimes had serious tempers, bort
we have our permits and we comply according to the law. If ARCO does too, great, but think of all the
honest Mom and Pop's out there that are stuck with a closed station and dirty property. 1'd rather help
them.
Please provide a written response to the questions I have posed_ Thank you.
CXl c
avid .
