Wilson, <br /> I am writing to file a complaint against the ARCO gasoline station located at the <br /> intersection of Highway 120 and Highway 99,Manteca,CA. This station appears not to be <br /> in compliance with the December 22, 1998 underground storage tank upgrades since there is no <br /> tank certification decal located on the windows of this facility. <br /> We are a distributor of petroleum products throughout San Joaquin County. We and our <br /> dealer customers were required to meet the requirements of the law or close our businesses until <br /> they could be brought in compliance. We had to close one location,many of our dealers were <br /> forced to close for upgrades that totaled over$154,000.00, and some of our san_aller dealers had <br /> to close their businesses permanently. To allow ARCO to continue to operate while not in <br /> compliance is an injustice to those who sought to comply with the law. This is a flagrant <br /> violation_that is being allowed,due to the size and power of ARCO. We and our customers were <br /> told that we would be shut down if we did not comply. <br /> Another issue thatneeds to be addressed is the fact that there is a$10,004/delivery fine <br /> for any fuel delivery company who delivers to a site that is not upgraded. is the Environmental <br /> Health Division going to enforce this aspect of the tank certification process by fining the <br /> supplier and carrier who are providing gasoline to this out of compliance location? <br /> T would appreciate your looking into this matter as soon as possible. We had to comply <br /> 75 days ago. Why is ARCO being allowed to flaunt their power and not comply with the <br /> requirements of the law? Please respond in writing.
