Aurora Street p <br /> Stockton, CA 95203 <br /> RESPONSE TO NOTICE OF VIOLATION AND WEEKLY PROGRESS UPDATE--REGIONAL BOARD <br /> ORDER NO.R5-2003-004412, SPEEDY FOODS,8200 N.HIGHWAY 99, STOCKTON, <br /> SAN JOAQUIN COUNTY <br /> I have reviewed the Letter Response to Notice of Violation (Letter) of the discharge requirements under <br /> Regional Board Order No. R5-2003-004412 (General Order), dated 10 December 2003, and the first <br /> Weekly Progress Update, dated 10 December 2003,both submitted on your behalf by Ground Zero Analysis,Inc. <br /> (GZA). I have the following comments to the Letter and the first Weekly Progress Update. <br /> • Thank you for your response to the Notice of Violation. Your decision to stop the discharge without waiting <br /> for regulatory approval was correct. In the future,please notify Regional Board staff immediately by phone, <br /> per the General Order, of any system failure resulting in a discharge of contaminants. Also note that the <br /> discharge limit for Methyl tert-Butyl Ether(MtBE) is the Secondary California Maximum Contaminant <br /> Level and Taste and Odor Threshold of 5 gg/L. <br /> • The Weekly Progress Update does not include all of the General Order-required constituents. The <br /> Notice of Applicability, dated 5 November 2003,requires the reporting of the following constituents: TPH, <br /> as gasoline (TPHg); benzene; toluene; ethylbenzene; total xylenes;fuel oxygenates including MTBE; lead <br /> scavengers; volatile organic compounds including ethanol, methanol, and trimethylbenzenes;polynuclear <br /> aromatic hydrocarbons, and general minerals. Revise Table 2 to also include all of the missing constituents, <br /> including all of the fuel oxygenates, the lead scavengers, the sum of the General Order-listed PNAs, all <br /> detected VOCs and results of ethanol and methanol analysis in future reports. Note that the analytical <br /> method detection limits should be the lowest achievable, and also allow comparison of analytical results to <br /> the lowest value of the General Order-listed Water Quality Objectives, if possible. <br /> If you have any questions regarding my comments, please telephone me at(916)464-4615. <br /> ?AMt.
