1.2 Certification Statement {§112.6(a)(1)) <br /> Professional Engineer Certification (40 CFR 112.3(d)) <br /> CERTIFICATION <br /> I hereby certify that we have examined the facility and being familiar with the provisions of 40 <br /> CFR 112, attest that this SPCC Plan has been prepared in accordance with good engineering practices <br /> This facility has greater than 10,000 gallons storage capacity and is not likely to cause substantial harm <br /> to a navigable waterway. This Professional Engineer certifies herein that he is familiar with the SPCC <br /> rule, has caused his representative to have visited and examined this facility, and that this SPCC Plan <br /> has been prepared in accordance with accepted and sound industry practices and standards; <br /> procedures for required inspections and testing have been established. The Plan is being fully <br /> implemented; the facility meets the qualifications criteria set forth under Section 112.3(g) of 40 CFR; <br /> the Plan does not include any environmental equivalence measures as described in Section 112.7(a)(2) <br /> or determinations of impracticability under Section 112.7(d) and the Plan and the individuals <br /> responsible for implementing the Plan have the full approval or management and the facility <br /> owner/operator has committed the necessary resources to fully implement the Plan. This PE certifies <br /> that the AST integrity test protocols as outlined in Appendix F herein, are, in compliance with Section <br /> 112.3(d) which specifically states that the PE certification of a Plan attests that "procedures for required <br /> inspections and testing have been established, and that the test and inspection methods and protocols <br /> are of good engineering practice, based on the professional judgment of the PE certifying this SPCC <br /> Plan in consideration of industry standards. In addition, recommended practices, safety considerations, <br /> and requirements of other federal, state, or local regulations have been considered in the development <br /> and PE certification of the SPCC Plan.. <br /> hereby certify that the above information on Certification is true and accurate to the best of my <br /> ability, and that all items under this SPCC Plan have been or will be fully implemented. <br /> Printed Name Of Registered P.E. <br /> Signature of Registered P.E. <br /> (Seal) <br /> Date—/—/2020 Registration Number State License <br /> This certification in no way relieves the owner or operator of the facility of his/her duty to <br /> prepare and fully implement this SPCC Plan in accordance with the requirements of 40 CFR part <br /> 112.
