streams), mudflats, sandflats, and wetlands, the use, degradation, or destruction
<br /> of which would affect or could affect interstate or foreign commerce including any
<br /> such waters:
<br /> o That are or could be used by interstate or foreign travelers for recreational
<br /> or other purposes;
<br /> o From which fish or shellfish are or could be taken and sold in interstate or
<br /> foreign commerce;
<br /> o That are used or could be used for industrial purposes by industries in
<br /> interstate commerce;
<br /> o All impoundments of waters otherwise defined as navigable waters per 40
<br /> CFR 110. 1 and 112.2;
<br /> o Tributaries of waters identified above, including adjacent wetlands, and
<br /> o Wetlands adjacent to waters identified above.
<br /> Oil. For the purposes of this plan, oil means oil of any kind or in any form, including, but
<br /> not limited to, petroleum, fuel oil, sludge, oil refuse, and oil mixed with wastes other than
<br /> dredged spoil (40 CFR 112.2). This term does not include propane.
<br /> Operator. Refers to any person in control of, or having responsibility for, the daily
<br /> operation of the storage tank. (Adapted from 40 CFR 280.12)
<br /> Owner. Any person — to include an individual, corporation, or federal agency— who
<br /> owns a storage tank system used for the storage, use, or dispending of a regulated
<br /> substance (adapted from 40 CFR 280.12). In the context of A.L.Powell Trucking , the
<br /> owner will normally be the facility office that is responsible for the operation of the oil-
<br /> containing storage tank, container, or equipment item. If a A.L.Powell Trucking
<br /> contractor effects operation and maintenance of the storage vessel or equipment item,
<br /> the terms of the contract should specifically designate the contractor as the operator of
<br /> the facility and delineate associated requirements. However, responsibility for day-to-
<br /> day compliance with applicable federal and California regulations and the requirements
<br /> of the SPCC Plan remains with the owning A.L.Powell Trucking office.
<br /> Petroleum. Petroleum including crude oil, or any fraction thereof, which is liquid at
<br /> standard conditions of temperature and pressure, which means 60 degrees Fahrenheit
<br /> and 14.7 pounds per square inch absolute. (23 CCR, Section 2611) Federal
<br /> regulations define 'petroleum oil'to include petroleum in any form including, but not
<br /> limited to, crude oil, fuel oil, mineral oil, sludge, oil refuse, and refined products (40 CFR
<br /> 112.2). This term does not include propane.
<br /> Regional Administrator. Refers to the Regional Administration of the EPA, or his/her
<br /> designee, in and for the region in which the facility is located (i.e., Region 9 for
<br /> A.L.Powell Trucking). (40 CFR 112.2)
<br /> Release. Includes any spilling, leaking, emitting, discharging, escaping, leaching, or
<br /> disposing from a storage tank into groundwater, surface water, or subsurface soils.
