5708 N. Hwy 99, Stockton
Page 3
system to the groundwater, and the groundwater flows southwest from the location of
the septic system, the drinking-water supply well may become impacted by these
chemicals in the future. All these factors, as well as the soil type, must be considered
when evaluating this UIC site. This is the reason for requiring that appropriately
registered professionals assess and recommend closure for UIC sites.
Since your site is also a Small Transient Non-Community Public Water System that is
regulated by the EHD, it will be a requirement that your well water be tested annually, by
a State certified laboratory, for Volatile Organics using EPA Method 524.2 and for TPH
as gasoline and diesel using the DHS LUFT Method until this property is closed as a UIC
site.
In addition, if the property ownership is transferred, the fact that the property is listed as
open on the EHD list of UIC sites must be disclosed to the new owner.
In order to receive closure as a UIC site the following is required:
1. An environmental consulting firm with an R.G. or P.E. (Civil) on staff must submit
a plan for assessing the site that will provide the information necessary to
evaluate the site and recommend closure.
2. The EHD will review the plan and provide approval and/or comment.
3. Once a plan is approved by the EHD, the work can be scheduled, and the EHD
must be notified in advance and be present during the work.
4. After completion of the work, a report including an evaluation of the findings,
signed by an R.G. or P.E. (Civil), must be submitted to the EHD.
5. The EHD will review the report. If the report recommends closure of the UIC site
and the EHD agrees with that recommendation, a closure letter will be provided
by the EHD and the site will be shown as closed on the EHD list of UIC sites.
It is unfortunate that you did not understand the requirements outlined in the previous
EHD letters and had work performed without the services of a qualified registered
professional to ensure that the work performed would be appropriate and adequate for a
site closure recommendation. Again, the first step in this process is to obtain the
services of an environmental consulting firm, with an appropriately registered
professional, to submit a plan for evaluating the site.
If you have any questions contact me at (209)468-3449, or Michael Infurna, Senior
REHS, at (209)468-3454.
Donna Heran, REHS, Director
Environmental Health Department
Margaret Lagorio, Supervising REHS
Unit IV
