On July 28, 2004 the water supply well was sampled by Precision Enviro-Tech Analytical at the <br /> request of the property owner, Mr. Patel. We understand that SJCEHD personnel were present <br /> to witness the sampling. The water sample was analyzed for purgeable organic compounds using <br /> USEPA Test Method 524.2, total petroleum hydrocarbons as gasoline and diesel using USEPA <br /> Test Method 8015M. All reported results were below analytical method detection limits. A <br /> report of findings was submitted to SJCEHD by High Tech Enterprises on November 1, 2004. <br /> Mr. Edward Finucane signed the report and concluded hat the St. Francis Motel water well is <br /> completely free of any dangerous contamination. <br /> Mr. Finucane is California licensed Mechanical Engineer#13749 with current registration until <br /> December, 2005. To our knowledge, Mr. Finucane is not a licensed Civil or Geotechnical <br /> Engineer who is able to sign reports regarding groundwater or hydrogeology under the State of <br /> California Professional. <br /> On November 8, 2004 SJCEHD again notified Mr. Patel that the conclusions submitted for <br /> clearing the St. Francis Motel water supply well must be signed by a California licensed engineer <br /> or geologist. SJCEHD also directed Mr. Patel that any recommendation from the signing <br /> professional must have a migration evaluation and determination stating that "no threat exists to <br /> the drinking water and that no further investigation is needed". <br /> Mr. Finucane submitted a letter to SJCEHD dated December 4, 2004 which refuted the basic <br /> requirements that SJCEHD had directed Mr. Patel to complete in order to rescind Order to <br /> Vacate of Room 108. In this letter to SJCEHD, Mr. Finucane reported that he did not posessthe <br /> California professional licenses to sign a report required by SJCEHD for site closure. <br /> SJCEHD responded to Mr. Finucane's letter dated December 4, 2004 by letter on January 10, <br /> 2005. In this letter, the position of SJCEHD requirements to complete the investigation was <br /> reiterated. A letter from SJCEHD dated January 28, 2005 was sent to Mr. Patel that again <br /> reiterated the requirements that must be met prior to SJCEHD rescinding the "Note to Vacate" <br /> for Room 108. <br /> On March 15, 2005 Mr. Patel retained this office to prepare and implement a workplan to <br /> complete the limited site assessment at the St. Francis Motel site.
