Suit A <br /> Sacramento, CA 9582 -3098 <br /> Dear Ms. Leary: <br /> On July 8, 1994, Isaac Kaing of your office was notified by telephone that Tri Valley Growers' <br /> Plant 4 had inadverte fitly discharged process water into Bear Creek. My conversation with Mr. <br /> Kaing indicated that the California Department of Fish and Game (CDF&G) was taking the lead <br /> in the investigation an it would be preferable to merely cover your department with <br /> correspondence betw6en Tri Valley and CDFBG. With this understanding, I have provided Mr. <br /> Kaing with a copy of te 15 July 1994, preliminary report to CDFBG which detailed the steps <br /> that were taken to res�Iore Bear Creek to its original condition and included copies of the <br /> analytical results that were obtained shortly after the release. A more detailed report <br /> identifying the cause of the release and the steps that have been taken to prevent a <br /> recurrence is being p pared and will be distributed shortly. <br /> I want to assure you that Tri Valley's intention was not to isolate your office from any <br /> information, but top vide all involved agencies with timely and accurate information related to <br /> the spill and subsequ nt clean-up. Your letter of 27 July 1994 indicated that your Department <br /> has a two-week wind4 w in which you require a detailed written response to a telephone <br /> notification. It was m intention that Tri Valley's 15 July 1994 letter would satisfy that <br /> requirement until the ina[ report could be prepared. <br /> In any event, you ha a requested more detailed information regarding the discharge. Tri <br /> Valley provides the following information in response to your request. <br /> On July 6, 19n-4, Plarit 4 was di,-,charging process water (rir,3e water and tomato by-product) <br /> into Field 4 located o the south side of Bear Creek. This discharge was pennitted under its <br /> Waste Discharge Re uirement. It was the first discharge into Field 4 since 1993. Due to a <br /> b ,ck up of the water n Field 4 the process water found its way to an old 4" pipe which was <br /> covered with weeds. The pipe ran from Field 4 through the Bear Creek levy, was exposed at <br /> both ends and acted as a conduit for a portion of the discharge water to be deposited into <br /> Bear Creek. Tri Val[ y was unaware of the potential for this pipe to act as a conduit at the tip pie <br /> of the incident. On 8 my 1994, caps were welded on both ends of the abandoned pipe; this <br /> will prevent recurren of the situation. <br /> P.O.
