CA0003913 <br /> WASTE DISCHARGE REQUIREMENTS <br /> FOR <br /> TRI VALLEY GROWERS, PLANT NO. 4 <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region, (here- <br /> after Board) finds at: <br /> 1. Tri Valley Growers, Plant No. 4 submitted a report of waste discharge, dated <br /> 9 April 1979. <br /> 2. Tri Valley Growers, Plant No. 4 discharges a maximum of 1.2 mgd into Bear <br /> Creek, a water of the United States, at a point in the NW 1/4 of Section 1, <br /> T2N, R6E, MOB M 6 miles north of Stockton during the months of July through <br /> October. The cannery also discharges a maximum of 3.0 mgd of process waste- <br /> water to spray irrigation fields during the same period. <br /> 3. The Board on 25 July 1975 adopted a Water Quality Control Plan for the Sacra- <br /> mento-San Joaquin Delta Basin. The Basin Plan contains water quality objectives <br /> for The San Joaquin River. <br /> 4. The beneficial uses of Bear Creek are: agricultural supply; recreation; esthetic <br /> enjoyment; and preservation and enhancement of fish, wildlife, and other aquatic <br /> resources. <br /> 5. Effluent limitation, and toxic and pretreatment effluent standards established <br /> pursuant to S ctions 208b, 301, 302, 303(d), 304, and 307 of the Federal Water <br /> Pollution Control Act and amendments thereto aYe applicable to the discharge. <br /> 6. The discharge from Tri-Valley Growers, Plant No. 4 is presently governed by <br /> waste dischar e requirements adopted by the Board on 26 July 1974 in Order No. <br /> 74-383 (CA000 913). <br /> 7. The action to adopt an NPDES permit is exempt from the provisions of the Calif- <br /> ornia Environmental Quality Act (Public Resources Code Section 21000, et seq.) <br /> in accordance with Section 13389 of the California Water Code. <br /> 8. The Board has notified the discharger and interested agencies and persons of <br /> its intent to prescribe waste discharge requirements for this discharge and has <br /> provided them with an opportunity for a public hearing and an opportunity to <br /> submit their written views and recommendations. <br /> 9. The Board in z public meeting heard and considered all comments pertaining to <br /> the discharge <br />
