r <br />INTRODUCTION <br />The National Oil a d Hazardous Substances Pollution Contingency Plan, as well as <br />federal regulations in 40 CFR, Part 112, state that the person responsible for the <br />discharge of oil or azardous materials should take appropriated action for containment <br />and recovery of su material. Cleanup activities will be evaluated by an agency of the <br />federal governmen . If cleanup is judged inadequate, the agency will direct further <br />operation, with the esponsible party to be liable for the resulting costs. <br />Union Pacific Railroad (UPRR) has the responsibility and authority to initiate and direct <br />response activities for the control of spills originating within facility boundaries. <br />Specifically, UPRRWII assume such responsibility for spills related to on-site operation, <br />filling, and maintenance of the operating equipment for this facility. <br />Pursuant to Section 112 of Title 40 of the Code of Federal Regulations [40 CFR 112], a <br />facility that manages oil above specified levels and which has the potential for a release <br />to enter a navigable water (without consideration of any secondary containment that may <br />be provided) shall prepare a Spill Prevention, Control and Countermeasure (SPCC) Plan <br />(Plan). A Plan is no required if (1) the underground buried storage capacity of the facility <br />is 42,000 gallons o less of oil, and (2) the aboveground storage capacity at the facility is <br />1,320 gallons or les of oil (aboveground containers of less than 55 gallons are not <br />included in calculati g aboveground storage capacity), and (3) due to its location, the <br />facility could not r sonably be expected to discharge oil into navigable waters. <br />This Spill Preventio , Control and Countermeasure (SPCC) plan (Plan) has been <br />prepared in accord nce with the applicable sections of 40 CFR 112. The Plan identifies <br />procedures, metho and equipment to prevent the discharge of oil from onshore and <br />offshore facilities int or upon the navigable waters of the United States. <br />PLAN REVIEW AND AMENDMENT <br />Amendment by Owner / Operator <br />Facility Change: If a change occurs in the facility design, construction, operation or <br />maintenance which materially affects the facility's potential for the discharge of oil into <br />or upon the navigale waters of the United States or adjoining shorelines, the SPCC <br />Plan will be amended. The Plan will be revised within six months of the change. The <br />amended Plan will be certified by a Registered Professional Engineer and facility <br />personnel will be tr 'ined on the changes, as necessary, to facilitate the effective <br />response to an act I or imminent discharge. Minor changes (e.g., personnel changes, <br />telephone number anges or other changes that do not increase the potential for or the <br />size of a spill) will n t require the Plan to be recertified. <br />Five -Year Review: The SPCC Plan will be reviewed and evaluated for completeness <br />and appropriateness at least once every five years. The review will include an <br />evaluation of whether new field -proven control technology exists which will significantly <br />reduce the chance of a spill event.
