Union Pacific Railroad
The National Oil and Ha
regulations in 40 CFR, P
hazardous materials she
Cleanup activities will bo
inadequate, the agency
resulting costs.
INTRODUCTION
irdous Substances Pollution Contingency Plan, as well as federal
rt 112, state that the person responsible for the discharge of oil or
ild take appropriate action for containment and recovery of such material.
evaluated by an agency of the federal government. If cleanup is judged
rill direct further operations, with the responsible party to be liable for the
Union Pacific Railroad (gPRR) has the responsibility and authority to initiate and direct response
activities for the control of spills originating within facility boundaries. Specifically, UPRR will
assume such responsibility for spills related to on-site operation, filling, and maintenance of the
operating equipment for this facility.
Pursuant to Section 112 of Title 40 of the Code of Federal Regulations [40 CFR 112], a facility that
manages oil above speci ied levels and which has the potential for a release to enter a navigable
water (without consider tion of any secondary containment that may be provided) shall prepare a
Spill Prevention, Control and Countermeasure (SPCC) Plan (Plan). A Plan is not required if (1) the
underground buried sto ge capacity of the facility is 42,000 gallons or less of oil, and (2) the
storage capacity, which s not buried, at the facility is 1,320 gallons or less of oil, and (3) due to its
location, the facility coul not reasonably be expected to discharge oil into navigable waters.
This Spill Prevention, Cotrol and Countermeasure (SPCC) plan (Plan) has been prepared in
accordance with the applicable sections of 40 CFR 112. The Plan identifies procedures, methods
and equipment to preve t the discharge of oil from onshore and offshore facilities into or upon the
navigable waters of the nited States.
PLAN REVIEW AND AMENDMENT
Amendment by Owner/Operator
Facility Change: If a chhe
nge occurs in the facility design, construction, operation or maintenance
which materially affects
facility's potential for the discharge of oil into or upon the navigable
waters of the United Sta es or adjoining shorelines, the SPCC Plan will be amended. The Plan will
be revised within six moths
of the change. The amended Plan will be certified by a Registered
Professional Engineer an
facility personnel will be trained on the changes, as necessary, to
facilitate the effective reponse
to an actual or imminent discharge. Minor changes (e.g., personnel
changes, telephone number
changes or other changes that do not increase the potential for or the
size of a spill) will not require
the Plan to be recertified.
Five - Year Review: Th
SPCC Plan will be reviewed and evaluated for completeness and
appropriateness at least
nce every five years. The review will include an evaluation of whether
new field -proven control
technology exists which will significantly reduce the chance of a spill
event. The Plan will be amended to include such new technologies that are determined to be
appropriate. Any amendments
made as a result of this review must be certified by a Registered
Professional Engineer.
Amendment by Regional Administrator
If during any twelve-month period the facility discharges into or upon the navigable waters of the
United States or adjoining shorelines more than 1,000 gallons in a single spill event or harmful
http://home.www.uprr.cortt/depts/EnvMgmt/Ceps/cfin/Reports/Info_Plan.cfm 10/29/03
