Specifically, UPRR will <br />assume such responsibility for spills related to on-site operation, filling, and maintenance of the <br />operating equipment for this facility. <br />Pursuant to Section 112 of Title 40 of the Code of Federal Regulations [40 CFR 112], a facility that <br />manages oil above speci ied levels and which has the potential for a release to enter a navigable <br />water (without consider tion of any secondary containment that may be provided) shall prepare a <br />Spill Prevention, Control and Countermeasure (SPCC) Plan (Plan). A Plan is not required if (1) the <br />underground buried sto ge capacity of the facility is 42,000 gallons or less of oil, and (2) the <br />storage capacity, which s not buried, at the facility is 1,320 gallons or less of oil, and (3) due to its <br />location, the facility coul not reasonably be expected to discharge oil into navigable waters. <br />This Spill Prevention, Co�trol and Countermeasure (SPCC) plan (Plan) has been prepared in <br />accordance with the applicable sections of 40 CFR 112. The Plan identifies procedures, methods <br />and equipment to preve t the discharge of oil from onshore and offshore facilities into or upon the <br />navigable waters of the nited States. <br />PLAN REVIEW AND AMENDMENT <br />Amendment by Owner/Operator <br />Facility Change: If a ch�he <br />nge occurs in the facility design, construction, operation or maintenance <br />which materially affects <br />facility's potential for the discharge of oil into or upon the navigable <br />waters of the United Sta es or adjoining shorelines, the SPCC Plan will be amended. The Plan will <br />be revised within six moths <br />of the change. The amended Plan will be certified by a Registered <br />Professional Engineer an <br />facility personnel will be trained on the changes, as necessary, to <br />facilitate the effective reponse <br />to an actual or imminent discharge. Minor changes (e.g., personnel <br />changes, telephone number <br />changes or other changes that do not increase the potential for or the <br />size of a spill) will not require <br />the Plan to be recertified. <br />Five - Year Review: Th� <br />SPCC Plan will be reviewed and evaluated for completeness and <br />appropriateness at least <br />nce every five years. The review will include an evaluation of whether <br />new field -proven control <br />technology exists which will significantly reduce the chance of a spill <br />event. The Plan will be amended to include such new technologies that are determined to be <br />appropriate.
