CONDITIONS OF APPROVAL <br /> UP-92-16 <br /> King & Lyons <br /> This approval will expire 18 months from the date of approval unless (1) all Conditlons of Approval <br /> have been complied with, (2) all necessary building permits have been secured and remain In force, <br /> and (3) all necessary permits from other agencies have been secured and remain In force. Nothing <br /> in this requirement shall preclude other requirements or obligations Included In the accompanying <br /> Development Agreement. This project is subject to, and shall comply with, all provisions of <br /> Development Agreement No. DA-90-1. <br /> 1. DEVELOPMENT SERVICES DIVISION: <br /> a. The approval is for the construction of the buildings depicted on the Use Permit Site Plan <br /> (DES Architects, Planner, Engineers) received May 18, 1992. <br /> b. The approval is for the construction of the approximately 67,500 square feet of warehouse <br /> and distribution space. <br /> C. A sign plan for the facility shall be submitted with the improvement plan. The sign plan <br /> shall be consistent with the comprehensive sign plan of the Patterson Pass Business Park <br /> as specified in Major Subdivision Application No. SU-92-2. <br /> d. Forty-four (44) parking spaces are required, including two spaces for the physically <br /> handicapped. <br /> e. An Improvement Plan, prepared by a Registered Civil Engineer, showing drainage, <br /> driveway access details, on-site parking, existing and proposed utility services, signs, <br /> landscaping, and grading shall be submitted to the Development Services Division for <br /> approval (Planning Title Section 9-10002). <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a. The Traffic Impact Mitigation Fee will be required for this development. The fee is due <br /> and payable at the time of building permit application. The fees currently are $2,214.00 <br /> per 1,000 gross square feet of building designated as 'Office' and $1,126.00 per 1,000 <br /> gross square feet of building designated as'Warehouse'in the Tracy area. If no building <br /> permit is required, the fee will be exempt The fee shall be automatically adjusted July <br /> 1 of each year by the Engineering Construction Cost Index as published by the <br /> Engineering News Record (Resolutions R-90-344 and R-91-1025). <br /> b. The Final Map for SU-92-2 shall be recorded, and all improvements shall be completed <br /> and accepted prior to occupancy (Planning Title Section 9-10002). <br /> Conditions of Approval - 1 - (UP-92-16) <br />
