4 . Planning Division: <br /> a. Excavation into the groundwater aquifer is prohibited. <br /> b. The Excavation and Rehabilitation Plan shall be revised so <br /> that rehabilitation in each phase is commenced prior to <br /> the second year of excavation in that phase . The revised <br /> plan shall be submitted to the Planning Division within <br /> thirty (30) days of application approval . <br /> c . Prior to utilization of the Tracy Boulevard haul route, <br /> the applicant shall submit to the Planning Division a <br /> recorded document showing that the U. S . Bureau of <br /> Reclamation has granted the applicant a project access <br /> easement over the Tracy Boulevard haul road. <br /> d. The applicant shall comply with the request of Chevron <br /> U. S .A. for work to be performed at the haul road crossing <br /> over Chevron' s 18-inch crude oil pipeline . Prior to uti- <br /> lization of the Tracy Boulevard haul route, the applicant <br /> shall submit to the Planning Division a letter from <br /> Chevron stating that the requested crossing work has been <br /> completed. <br /> e . Prior to the commencement of operations, the applicant <br /> shall submit to the Planning Division a financial guaran- <br /> tee for Phase I rehabilitation. The guarantee is to have <br /> been previously approved as to its amount by the <br /> Department of Public Works and as to its form by County <br /> Counsel . The same procedure is to be followed prior to <br /> the commencement of excavation in each subsequent project <br /> phase . <br /> f . The applicant shall submit to the Planning Division an <br /> annual , written report prepared by a licensed civil <br /> engineer . This report shall describe the Phase II <br /> compliance status relative to the requirements of the <br /> County Planning Title and to the conditions of approval <br /> adopted as part of this permit approval . The report shall <br /> also describe the excavation and rehabilitation completed <br /> in the preceding twelve ( 12 ) month period. The first <br /> report shall be submitted April 1 , 1987 . <br /> g. The applicant shall submit to the Planning Division veri- <br /> fication that the project has received all necessary plan, <br /> permit, or program approvals from the Regional Water <br /> Quality Control Board, no later than sixty (60) days from <br /> the date of application approval . <br /> h. Operations may be conducted Monday through Saturday, <br /> between the hours of 5 :00 a.m. and midnight . <br /> Conditions of Approval - 2 - (QX-86-4) <br />
