On 27 October 2008, San Joaquin County Environmental Health <br /> Department (SJCEHD) approved the scope of work detailed in the 30 May 2008 work plan. <br /> As SJCEHD is aware,the site is funded by the Underground Storage Tank Cleanup Fund(USTCF). <br /> As of 23 October 2008, the USTCF notified all claimants that due to financial issues within the <br /> USTCF and as exasperated by the State and National economic crisis,that reimbursement payments <br /> and funding will be delayed. Additionally, the USTCF stated that all claimants should take all <br /> appropriate steps to immediately reduce costs until funding is resumed. Further,in their 28 January <br /> 2009 letter,the USTCF announced that Priority Class `B' claims, of which this site is,will have up <br /> to 18 months delay in receiving reimbursement payments. <br /> As SJCEHD may not be aware, environmental work at the site is completely dependent on funding <br /> from the USTCF.In an attempt to minimize additional reimbursement delays,AGE requested a"pre- <br /> approval" of costs, on behalf of Canepa's, for the scope of work detailed in the 30 May 2008 work <br /> plan and approved by the 27 October 2008 SJCEHD letter. <br /> In a letter dating 11 March 2009 SJCEHD required that permitting and field work associated with <br /> the Additional Site Assessment Work Plan (Work Plan), dated 30 May 2008, be completed within <br /> a 30 and 60-day time period. AGE responded in a quarterly status letter dating 27 March 2009, <br /> requesting an additional 60-day extension.
