Margaret Lagorio, if necessary do you wish to address?
MS.LAGORIO: Oh,no I just wanted to make sure that you all were aware of the
lawsuit...[can't hear-rao far from speaker]
CHAIRMAN: Alright thank you. Sherry Kirk. Morning.
MS.KIRK: Good morning Mr.Chairman and members of the Board, I'm Sherry Dirk,I am an
attorney in private practice here in Sacramento and i'm here this morning on behalf of Unocal
Corporation. My remarks are gonna be rather brief and I will then ask Ur. Cullen, who is here
with us to also address the.Board,Dr. Cullen drafted the written comments first we submitted.
(_ONLV6r V!,-1t-
13b just briefly I'd like to say that we eafteurrent-stafrs,recommendation needless to say and for
all the reasons stated in both our closure petition and the yellmk peed petition. We believe the
site should be closed at this time, however in the spirit of compromise and in line with what we
have attempted to do throughout this dispute,Unocal will consent to the proposed order and
continue to conduct the monitoring that it is presently conducting at the site for another year. We
also urge this Board to adapt the portion of the order that requires San Joaquin County to refrain
from requiring additional action at this site during the course of this additional monitoring. In
our LOP Petition we also requested this Board issue a stay of San.Ioagtdn's actions and I think
the events of the last 24 hours make the reasons for our request even more compelling.
