I Chapter 6.7 pursuant to Health and Safety Code § 25299 in an amount according to proof, but not <br /> 2 less than FIVE MILLION DOLLARS ($5,000,000.00). <br /> 3 3. Defendants herein be assessed a civil penalty of TEN THOUSAND DOLLARS <br /> 4 ($10,000.00) per day per underground storage tank for each violation of Health and Safety Code <br /> 5 Chapter 6.75 pursuant to Health and Safety Code § 25299.76 in an amount according to proof, <br /> 6 but not less than FIVE MILLION DOLLARS ($5,000,000.00). <br /> 7 4. Defendants herein be assessed a civil penalty of FIFTEEN THOUSAND <br /> 8 DOLLARS ($15,000.00) per day per underground storage tank for each violation of Health and <br /> 9 Safety Code 42400 et seq. pursuant to Health and Safety Code § 42402.1 and § 42403 in an <br /> 10 amount according to proof, but not less than FIVE HUNDRED THOUSAND DOLLARS <br /> 11 ($500,000.00). <br /> 12 5. All defendants herein be assessed a civil penalty of TWO THOUSAND FIVE <br /> 13 HUNDRED DOLLARS ($2,500.00) for each act of unfair competition, in an amount according <br /> 14 to proof but not less than TWO MILLION FIVE HUNDRED THOUSAND DOLLARS <br /> 15 ($2,500,000.00), pursuant to Business and Professions Code §17206. <br /> 16 6. The San Joaquin County Department of Public Health Services Environmental <br /> 17 Health Division be reimbursed for their costs in investigating and prosecuting this action. <br /> 18 7. Plaintiff recover its costs. <br /> 19 8. Pursuant to Health and Safety § 25299.01 and Business and Professions Code <br /> 20 § 17204, for a final and permanent injunction restraining and enjoining defendants and each of <br /> 21 them, and their directors, officers, partners, agents, employees, representatives, and all persons <br /> 22 acting under or in concert with defendants with actual or constructive notice of any injunction <br /> 23 issued in this matter from doing directly or indirectly any of the following acts: <br /> 24 A. Violation of any of the applicable requirements of the permit issued for the <br /> 25 operation of the underground tank system. (Health & Safety Code §25299(a)(2)); <br /> 26 B. Failure to maintain records, as required by this chapter. (Health and Safety Code § <br /> 27 25299(a)(3)); <br /> 28 C.
