As Mr. Atwater stated below, he has concerns regarding future <br /> liability for any damages that could potentially be caused following usage of the 100 grain detonation cord. Can <br /> the EHD give assurances that Van De Pol Enterprises Inc. (Mr. Atwater) will not be held liable for any damages <br /> that may have been the result of using the below referenced explosives to abandon the well? <br /> Thank you for your explanation below. When first brought to our attention during a telephone conversation that <br /> the EMD was going to amend the EHD-approval letter(dated 09-05-12), our initial concerns were focused on <br /> tank fund issues and the added cost to the well abandonments, rather than liability.We wanted to be sure that <br /> the tank fund would reimburse the added work. However, upon receiving the new directive letter(dated <br /> 11/06/12), Mr. Atwater had immediate liability concerns. <br /> Also,you mentioned that AGE may have been involved this past summer with CMT well abandonments using <br /> explosives.We were not involved with those abandonments, rather the RWQCB took over that project as an EAR <br /> site. Based on a telephone conversation with Mr.Jim Barton of the RWQCB, he mentioned that the effectiveness <br /> of using explosives at this site had mixed results. <br /> We believe if Mr. Atwater can be assured that he has no added liability,that he will authorize the additional <br /> work. <br /> Thanks—Tim Cuellar <br /> Timothy J. With grout already placed in the well at your site,the grout will absorb and muffle the impact keeping the <br /> energy of the blast contained in the well to best cause the well to break apart, when the detonation takes place. <br /> The overall impact of the blast is very insignificant. The explosives used at your site will produce energy that will <br /> extend not more than ten feet out from the center of the borehole, according to the explosive expert.
