In order to facilitate your review of the case for
closure you requested that Chevron provide a copy of the 1993 report describing overexcavation
activities at the subject site (letter attached). Two months after providing the requested report, I
received a call from San Joaquin County Public Health Services informing me that you were still in
need of the 1993 overexcavation report. When I called you to verify this you stated that the copy
provided in July, 1994 was received and that the copy originally provided in June, 1993 was
located in your agency's files. Another prompt for case closure was provided to you in October,
1994 during transmittal of a semi-annual groundwater monitoring report(letter attached).
To this date there has been no case closure issued. For that matter, there has been no decision at all
issued by your agency on the original April, 1994 case closure recommendation. The thirty day
response period from initial request was not met by your agency. Duplicate requests for
information previously provided to your office have caused needless delay. Both parties have been
more than patient. Further, Chevron sees no value in acquiring redundant ground water.monitoring
data while waiting for your agency to respond. As such, all monitoring activities'have been
suspended until a closure decision has been reached.
On behalf of the property owner's and Chevron, I request your prompt reply to the
recommendation for closure. If you have.,any questions or comments, please call me at(510) 842-
8695.
Sincerely,
, A4X_1
Brett L.
