This condition, apparently of many
years duration, is that for which the monitoring wells were
required.
We understand that Chevron intends to remove the contaminated soil
from the tank areas and replace it with clean fill . We also
understand that Chevron has not yet decided on a remediation for
the contamination resulting from the product spill . Apparently one
alternative would be to excavate, stockpile and aerate the soil
until the contamination is reduced to acceptable levels . The soil
would then be returned to the excavation. That is not acceptable to
the owners .
The owners have an alternative use for the property which requires
that the premises be returned to them as soon as possible. Given
that Chevron has known about the product release for years and that
its lease allows only a reasonable time to accomplish the removal
of the improvements and remediation of the site, the owners insist
that Chevron remediate by the most expedient means, even if that is
not the cheapest. Additionally, we require that all of the
monitoring wells be closed and abandoned in accordance with County
requirements as part of the closure. Should the alternative use be
lost because Chevron did not diligently pursue its obligation to
deliver the site in a timely manner, we would look to Chevron to
compensate for the loss .
