Box 5004 P R� III �Avd� S <br /> HEALTH <br /> San Ramon, CA 94583-0804 SI:"v <br /> Re: Chevron Station No. 9-6465 <br /> 5608 North Pershing Avenue <br /> Stockton, California <br /> Dear Mr. Purcel : <br /> we recently learned that, in addition to contaminated soil adjacent <br /> to the waste oil disposal. tank and in the bottom of the major tank <br /> pit of the above referenced property, there have been product <br /> releases from the distribution pipes in the vicinity of monitoring <br /> wells one ( 1) and two (2 ) . This condition, apparently of many <br /> years duration, is that for which the monitoring wells were <br /> required. <br /> We understand that Chevron intends to remove the contaminated soil <br /> from the tank areas and replace it with clean fill . We also <br /> understand that Chevron has not yet decided on a remediation for <br /> the contamination resulting from the product spill . Apparently one <br /> alternative would be to excavate, stockpile and aerate the soil <br /> until the contamination is reduced to acceptable levels . The soil <br /> would then be returned to the excavation. That is not acceptable to <br /> the owners . <br /> The owners have an alternative use for the property which requires <br /> that the premises be returned to them as soon as possible. Given <br /> that Chevron has known about the product release for years and that <br /> its lease allows only a reasonable time to accomplish the removal <br /> of the improvements and remediation of the site, the owners insist <br /> that Chevron remediate by the most expedient means, even if that is <br /> not the cheapest. Additionally, we require that all of the <br /> monitoring wells be closed and abandoned in accordance with County <br /> requirements as part of the closure. Should the alternative use be <br /> lost because Chevron did not diligently pursue its obligation to <br /> deliver the site in a timely manner, we would look to Chevron to <br /> compensate for the loss . <br />
