D. In instances where two or more codes are at variance, the most restrictive requirements shall <br /> apply. <br /> E. Nothing on the design drawings or in the specifications shall be construed to permit work or <br /> materials not conforming to the preceding codes and standards. <br /> F. The term "Contractor" shall mean the supplier or representative that is responsible for providing <br /> the equipment specified herein. <br /> G. The term "equipment" used herein shall mean any device or accessory furnished or provided <br /> under these design documents. <br /> H. The Contractor shall furnish without extra charge any additional material and labor which may <br /> be required for compliance with these codes and standards, even though the work is not <br /> explicitly mentioned in these design documents. <br /> 1.3 PLANS AND SPECIFICATIONS <br /> A. The bidder shall examine carefully the plans and specifications. It will be assumed that the <br /> bidder has investigated and is satisfied as to the conditions to be encountered, as to the character, <br /> quality and quantities of work to be performed and materials to be furnished, and as to the <br /> requirements of these specifications and the contract. After the signing of the Contract, no <br /> consideration will be given to any claims of misunderstanding of the work to be done, or of any <br /> provisions of the plans, specifications and contract documents. <br /> B. All equipment/options are to be factory installed. If the equipment/options are not available <br /> factory installed, dealer installed equipment/accessories may be acceptable. The Contractor is <br /> to specify those items which will be dealer installed in the submitted bid document. <br /> C. Only new models in current production, that meet the requirements of these specifications and <br /> which are cataloged by the manufacturer and for which manufacturer's published literature and <br /> printer specifications are currently available, will be considered.
