1 G2. 08 Proposal Guaranty. The proposal must be accompanied by a <br /> bidder ' s bond, certified check , or cashier ' s check in an amount <br /> not less than ten percent (10%) of the amount of the bid , <br /> payable to the Agency. <br /> G2.09 Competency of Bidder. The bidder shall be licensed under the <br /> provisions of Chapter 9 , Division 3 , of the Business and <br /> Professions Code of the State of California to do the type of <br /> ' work contemplated in the project, and shall be skilled and <br /> regularly engaged in the general class or type of work called <br /> for under this contract. <br /> It is the intention to award a contract only to a bidder who <br /> furnishes satisfactory evidence that he has the requisite <br /> experience and ability and that he has sufficient capital , <br /> facilities, and plant to enable him to prosecute the work <br /> successfully and promptly, and to complete it within the time <br /> stated in the contract. <br /> To determine the degree of responsibility to be credited to a <br /> bidder , any relevant evidence will be considered that the <br /> bidder , or personnel guaranteed to be employed in responsible <br /> charge of the work , has satisfactorily performed other <br /> contracts of like nature and magnitude or comparable difficulty <br /> at similar rates of progress. <br /> G2- 12 Disqualification of Bidders. More than one proposal from any <br /> individual , firm or partnership , a corporation or an <br /> association , under the same or different names , will not be <br /> considered. Reasonable grounds for believing that any bidder is <br /> interested in more than one proposal for the work will cause <br /> the rejection of all proposals in which such bidder is <br /> interested. If there is reason to believe that collusion exists <br /> among the bidders , none of the participants in such collusion <br /> will be considered. Proposals in which the prices obviously are <br /> unbalanced or excessive may be rejected. <br /> G2. 11 Relief of Bidders. Attention is directed to the provisions <br /> of the State of California Government Code Section 4200 and <br /> following , concerning relief of bidders and in particular to <br /> the requirement therein that if the bidder claims a mistake was <br /> made in his bid , the bidder shall give the Agency written <br /> ' notice within five (5) days after the opening of the bids of <br /> the alleged mistake, specifying in the notice in detail how the <br /> mistake occured. <br /> 3. AWARD AND EXECUTION OF CONTRACT <br /> G3. 01 Consideration of Proposals . After the proposals have been <br /> opened and read , they will be checked for accuracy and <br /> compliance with these Specifications. <br /> G-7 <br />
