G4. 07 Subcontracting and Assignment The performance of the , contract may not be subcontracted or assigned except upon written consent of the Agency , and no such subcontracting or assignment shall be permitted which would relieve the original , Contractor or his surety of their responsibilities under the contract. The Contractor shall not, without the written consent of the ' Agency, (a) substitute any party as contractor in place of the subcontractor designated in the original bid, or (b) permit any such subcontract to to assigned or transferred, or allow it to , be preformed by anyone other than the original subcontractor listed on the bid . Such substitution shall be done in conformance with the Subletting and Subcontracting Fair Practices Act, Chapter 2, Division 5, Title 1 of the Government Code of the Statutes of the State of California. The Contractor may assign monies due or to become due him under the contract and such assignment will be recognized by the Agency, if given proper notice thereof , to the extent permitted by law, but any assignment of monies shall be subject to all deductions provided for in the contract, and all money withheld shall be subject to being used by the Agency for the completion of the work in the event that the Contractor should be in default therein. G4.08 Recognition of Subcontractors . No subcontractor will be recognized as such , and all persons engaged in the work under , this contract will be considered as employees of the Contractor , and their work shall be subject to all the provisions of the contract. The Agency and its representatives ' will deal only with the Contractor who shall be responsible for the proper execution of the entire work. G4. 09 Lands and Rights of Way. The Agency shall provide the lands, rights of way , and easements upon which the work under this contract is to be done , and such other lands as may be designated on the contract drawings for the use of the , Contractor and the Contractor shall confine his operations to within these limits. The Contractor shall provide at his own expense any ' additional land and access thereto that may be required for temporary construction facilities or for storage of materials. G4 . 10 Liability of A encY Officials . Neither the Engineer , the , Agency , nor its officers , employees , agents , or representatives , nor any of them shall be responsible for any loss or damage that may happen to the work or any part thereof, or for any of the materials or other things used or employed in finishing and completing the work , or for any injury to any person or persons, either workmen or the public , or for damage ' G-14 '
