' to adjoining property from any cause resulting from the Contractor ' s operations or the activities of his employees . G4 . 11 Contractor Not an Agent of the Agency. The right of general supervision shall not make the Contractor an agent of the Agency ; and the liability of the Contractor for all damages to ' persons or to public or private property, arising from the execution of the work , shall not be lessened because of such general supervision. ' G4 .12 Guarantee. For a period of one year commencing on the date of acceptance of the work , or that portion of the work described as substantially complete in any Partial Completion ' Certificates, the Contractor shall, upon the receipt of notice in writing from the Agency, promptly make all repairs arising out of defective materials , workmanship, or equipment. The Agency is hereby authorized to make such repairs if , 10 days after the giving of such notice to the Contractor , the Contractor has failed to make or undertake with due diligence the repairs ; provided , however , that in the case of an ' emergency, where, in the opinion of the Agency , delay could cause serious loss or damage , repairs may be made without notice being sent to the Contractor , and all expense in connection therewith shall be charged to the Contractor . For the purpose of this article, "acceptance of the work" ' shall mean the acceptance of the work , or a portion of the work, by the Agency in accordance with Paragraph G8. 06, but not for the purpose of extinguishing any covenant or agreement on the part of the Contractor to be performed or fulfilled at the time of such acceptance, all of which covenants and agreements shall continue to be binding on the Contractor until they have been fulfilled. ' Guarantee on equipment shall commence upon acceptance of the work by the Agency as specified in Paragraph G8 . 06. Any portion or part of a piece of equipment or other guaranteed item that has been replaced , repaired , or modified to correct a deficiency covered by the guarantee shall be deemed to have a separate agreement of one year covering only that portion of the work. The guarantee period covering this portion of the work shall commence upon the completion of the replacement, repair , or modification and return of the equipment to full operation and issuance of written acceptance therefor by the ' Agency. The requirements set forth in the above provisions are in no way a waiver of the Agency' s rights against the Contractor or suppliers for any deficiency, negligence, or omission which may be subsequently discovered.
