plan for worker protection from the hazards of caving <br /> ground during the excavation of such trench. Such plan <br /> shall be submitted at least 5 days before the Contractor <br /> intends to begin excavation for the trench and shall show <br /> the details of the design of shoring , bracing , sloping , <br /> or other provisions to be made for worker protection <br /> during such excavation. No such plans shall allow the use <br /> of shoring , sloping or a protective system less effective <br /> than that required by the Construction Safety Orders of <br /> the Division of Industrial Safety and if such plan varies <br /> from the shoring system standards established by the <br /> Construction Safety Orders , the plan shall be prepared <br /> and signed by an Engineer who is registered as a Civil or <br /> Structural Engineer in the State of California. <br /> In addition, the Contractor shall obtain, pay for , and <br /> comply with all provisions of the permit required by <br /> Section 6500 of the California Occupational Safety and <br /> Health Act of 1973. <br /> In accordance with the provisions of Section 6707 of <br /> the State Labor Code, each bidder shall list, in the Bid <br /> Items indicated, the amount contained in his proposal for <br /> adequate trench and excavation , sheeting , shoring , and <br /> bracing or equivalent method for the protection of life <br /> and limb which shall conform to applicable Safety Orders. <br /> By listing this sum in his proposal, the bidder warrants <br /> that his action does not convey tort liability to the <br /> Owner , the Owner ' s employees, or the Engineer . <br /> G6 02 Responsibility of the Contractor . The Contractor shall do <br /> all of the work and furnish all labor , materials , tools , <br /> equipment , and applicances , except as otherwise herein <br /> expressly stipulated , necessary or proper for performing and <br /> completing the work herein required , including any changes <br /> thereto authorized by an approved contract change order , in <br /> conformity with the true meaning and intent of the contract <br /> drawings , specifications , and all provisions of the contract, <br /> within the time specified. <br /> The work shall be under the Contractor ' s responsible care and <br /> charge until its completion and final acceptance, and he shall <br /> bear the entire risk of injury , loss , or damage to any part <br /> thereof by causes of any nature whatsoever . He shall rebuild , <br /> repair , restore , and make good all injuries, losses or damage <br /> to any portion of the work or the materials occasioned by any <br /> cause, and shall bear the entire expense thereof. <br /> ' If the Contractor discovers any discrepancies during the <br /> course of the work between the contract drawings and conditions <br /> in the field , or any errors or omissions in the contract <br /> drawings, the specifications, or in the layout given by stakes, <br /> G-25 <br />
