Points, or instructions , it shall be his duty to inform the t Engineer immediately, and the Engineer shall promptly verify the same. Any work done after such discovery or as a result of failure of the Contractor to discover patent defects will be done at the Contractor ' s risk. In no case shall the use of subcontractors in any way alter ' the position of the Contractor or his sureties with relation to this contract. When a subcontractor is used the responsibility for every portion of the work shall still remain with the Contractor. ' The Contractor shall assume the defense of, and indemnify and save harmless the Agency, its officers, employees, and agents, ' the Consulting Engineer, and each and every one of them from all suits , actions , damages , or claims of every type and description to which they may be subjected or put by reason of or resulting from negligence or carelessness on the part of the ' Contractor , his employees , or agents in the execution of the work or delivery of materials and supplies, or by or on account of any act or omission of the Contractor , his employees or agents , including any failure to fulfill the terms of any laws or regulations which apply to the contract; and the Contractor shall reimburse the Agency , its officers , agents , and employees, or causes of action which may be brought or served against the Agency, its officers, agents, or employees. The mention herein of any specific duty or responsibility imposed upon the Contractor shall not be construed as a limitation or restriction of any other responsibility or duty imposed upon the Contractor by the contract, said reference being made herein merely for the purpose of explaining the specific duty or responsibility. G6.03 Permits and Licenses. The Contractor , as required , shall ' procure all permits and licenses, pay all charges and fees, and give all necessary notices incident to the lawful prosecution of the work. He shall comply with all laws, ordinances , rules , and regulations bearing on the conduct of the work as drawn and specified. G6. 04 Protection of Agency Against Patent Claims. The Contractor i shall assume all costs arising from the use of patented materials , equipment , devices , or processes used on or incorporated in the work , and agrees to indemnify and save ' harmless the Agency , its officers , employees , and agents ( including the Engineer ) , from all suits at law or claims brought or made by the holder of any invention or patent for or on account of the use of any patented materials , equipment, devices , or process in the construction of or subsequent operation of the project .
